ACMO/CCI CONFERENCE 2005 -- HIGHLIGHTS Ethics for Property Managers and Others By Mario Deo, LLB IN ANY professional organization, the credibility and indeed the viability of the organization depends upon the organization being able to govern its members credibly and effectively. Having a system that works on paper is important. However, what is even more essential is the perception that the system works, whether that perception is in the eyes of the public or the members of ACMO. If either the public or ACMO's members do not believe that the Code of Ethics is effective and enforceable, then a serious problem exists that affects the foundation of ACMO as an organization. ACMO's mission statement is the starting point in understanding the foundation of the Code of Ethics. ACMO's Mission Statement: ACMO will advance the quality performance of condominium property managers and management companies in Ontario by: · Offering professional development programs; · Representing the interests of the members to governments, other associations, the media, condominium corporations and the general public; · Providing programs which regulate the conduct of the members; · Promoting the members and the association within ACMO, to the condominium community and to the general public; · Supporting the members through the provision of networking, group services and resources; · Being responsive to the needs and wishes of the membership. Points three and four in ACMO's mission statement are the main impetus for the creation of the Code of Ethics. CODE OF ETHICS. There are two codes of ethics under ACMO. One is the Code of Corporate Ethics and the other is the Code of Professional Ethics. They are similar codes. The former applies to property management firms while the latter applies to individual property managers. Both codes are available on the ACMO website. THE PATH OF A COMPLAINT. A complaint is initiated by providing it in writing to the Ethics Committee. Generally, the complainant must fill out the Questionnaire Form in order for the Committee to deal with the complaint. The form is appended to this article. The Ethics Committee may decide that the complaint will not be investigated because the complaint is frivolous or vexatious.

Where the complaint is by a unit owner that is not sent through the Board of Directors of the condominium corporation, the committee cannot deal with the complaint. If the Ethics Committee decides that the matter is a significant breach of the Code or that further facts are needed, it may conduct an investigation of the matter. An investigation usually consists of correspondence between the Committee and the parties. No formal procedure is used, however, the Committee must ensure that all parties are given an opportunity to present their version of the facts to the Committee. The Committee must determine whether ACMO's bylaws, its regulations or the Code of Ethics has been breached. The responding party has an obligation under the Code of Ethics to cooperate and not to interfere with any investigation of the Ethics Committee. No person involved in a complaint may contact the Ethics Committee members personally about the matter. The suggested timelines for conducting an investigation are as follows: · Notice to the member of the complaint or concern: one month after receipt · Response by member: one month after notification; · Approach of other possible witnesses or holders of relevant documents: two weeks after response by member · Decision of Ethics Committee: three months after member's response · Reasons for decision, notification of the member and any complainant and report to Board of Directors: one month after decision of Ethics Committee The Ethics Committee, after its investigation of the matter, has two basic options: 1. The Committee may issue an "advice, caution or warning". This is a non-punitive educational action designed to "assist members to enhance their practices and to prevent further difficulties of a similar nature arising in the future." (Quote is from the Code of Ethics). This would end the matter. 2. The Committee may alternatively decide that the alleged breach is serious enough to be referred to the Discipline Committee. There are no guidelines that govern what makes a matter serious enough to be referred to the Discipline Committee. The Ethics Committee members are entrusted with this decision and must apply common sense and judgment to their decision. The Discipline Committee is a quasi-judicial body. It will hold a hearing of the matter. The procedure for Discipline Committee hearings is set out in the "Guidelines For Complaints and Discipline" as promulgated by ACMO. At the hearing, the Ethics Committee makes submissions on behalf of ACMO. The responding party is entitled to make submissions personally, or may be represented by a lawyer. The complainant is not entitled to be present at the hearing. Hearings are not open to the public.

If a finding is made against the member, the Guideline states that all parties should be given an opportunity to introduce additional documents and witnesses and make additional submissions as to what order ought to be made. The Powers of the Discipline Committee include anything from a verbal reprimand to a revocation of ACMO membership or any designation issued by ACMO. Written reasons are not required but are encouraged by the Guideline. Any party may appeal to the Appeal Committee. No new evidence is allowed at the appeal. Please provide the full name and contact information about the person the complaint is about. · Summarize what the person did. · What sections of the Codes of Ethics or bylaws do you believe this conduct infringes (the final determination of this is up to ACMO and its committees, but your thoughts would be helpful). · Provide the name(s) and contact information for each witness to this conduct and summarize what you believe the witness observed. · Provide a copy of all relevant documents relevant to this complaint. MEMBERSHIP UPDATE 2006 ACMO Corporate Member Profile Condominium management companies that are Corporate members of ACMO should be the preferred choice when corporations select new management, for these reasons: Every ACMO Corporate member has agreed to observe the ACMO Corporate Professional Code of Ethics in the conduct of its business. Many management companies have been ACMO 2000 certified by the Condominium Management Standards Council, an independent body established by ACMO to oversee its 2000 Certification Program.
