USING CONTRACTED DRIVERS?

THINGS YOU SHOULD KNOW

any of our businessowners hire independent contracted drivers for their delivery needs. Many of these drivers fail to obtain or maintain their own insurance for their service. Also, many businessowners are unaware what information they should obtain or require to protect or limit their exposure from any claims arising from these drivers.

RECEIVED THE PRESTIGOUS 2009 PRESIDENTS CLUB AWARD.

AYRES-RICE INSURANCE, Part of The Ayres Group,

M

OUR AGENCY WAS SELECTED FROM OVER 1,000 AGENTS TO RECEIVE THIS HONOR FOR THE SECOND YEAR IN A ROW! THIS SIGNIFIES OUR COMMITMENT TO OUR CUSTOMERS

We recommend you take the following actions with any of your contracted drivers:

1) Use a signed contract for services to be performed including: a) Statement that they are hired as Independent Contractor, not employee and as such are not eligible for any benefits provided to employees b) Waiver of liability and subrogation c) Paid by job 2) Obtain and keep current on file Certificate of Insurance showing liability, cargo and workers compensation coverage. 3) If Sole Proprietor, obtain Notice to Subcontractor/Independent Contractors Worksheet form. These forms are available www.caom.com or call our office and we can provide you one. 4) If Corporation, "S" Corporation or LLC, obtain form #BWC-337 which needs to be filed with the State of Michigan by the Independent Contractor. a) The Independent Contractor must call the State of Michigan at(517) 322-1195 and will be asked some brief questions to determine whether or not they are required to carry Workers Compensation Insurance. If they are not, then form BWC-337 will be issued and placed on file. Ask them to provide you with a copy of this form.

If you have any questions or concerns regarding your independent contracted drivers please do not hesitate to give our office a call.

ith our distressed economy and housing market, many people have no alternative but to move and vacate their dwelling and landlords loose tenants for various reasons. When a home becomes unoccupied or vacant, there are two primary problems. The house can become a target for theft and vandalism or a water loss that has gone undetected which can cause extensive damage. Because of these exposures insurance companies have strict requirements regarding vacant dwellings.

VACANT HOME = INSURANCE COVERAGE PROBLEMS

Impact

on

coverage

Homeowners or Dwelling Fire policies will exclude vandalism coverage after a home is vacant for longer than 60 days. The policy also does not cover frozen pipes if you have not maintained heat or drained pipes. Worse yet, some insurance companies will completely deny any claim when a dwelling is unoccupied or vacant. If your home is vacant or becomes unoccupied, including rental properties, please notify our office immediately and inform us of your situation. Some of our companies may accommodate your situation for a short period of time, however, we are obligated to disclose all details, and their decision may be to issue direct notice of cancellation. We have a few excellent companies that specialize in vacant dwelling coverage and even short term policies are available in case the situation is not long term. Please contact our office if you are or become in this situation so we may properly cover your home.
