APPLICATION SUBMISSION

It is critical in the immigration application process that you use the most current forms and submit all necessary information to the proper government agency or agencies. Applications often include multiple application forms that need to be submitted to multiple government agencies, including USCIS, DHS, the Department of State and the Department of Labor. An incorrect application submission can delay your case, or possibly cause your application to be denied. PREPARATION CHECKLIST Verify that you have the correct application form, and that you have all the forms you need for this application. Determine whether or not there is a filing fee for this form. Acquire all the necessary information to complete the form. Determine where to submit the application once it is completed. Acquire all the necessary documentation that needs to be included with the application. Make sure the documentation meets requirements (original, certified, notarized, etc.) Find out what process to follow if you do not receive a response to your application. Determine how to track application status.

APPLICATION CHECKLIST Read instructions carefully, and make sure you understand each part of the form. Include all required documentation. Make copies of all documentation, payment, and application forms before submitting. Send application to correct address via registered mail with delivery confirmation. Only send original documents if required. If required to send originals make sure you follow instructions for requesting the documents back. Include the filing fee, if required. If paying by check be sure your account has the funds. Sign and date everywhere that it is required.

DOCUMENTS IN A FOREIGN LANGUAGE If the documents you are required to submit with your application are in a foreign language, and you are submitting an application to a U.S. Embassy or Consulate, then it is recommended that you contact them first to find out whether or not you will be required to include a certified translated copy. If you contact them then it is a good idea to ask if your application should be submitted to a specific person or department. When submitting a foreign document to a government agency in the U.S., you will probably be required to include a complete translation of the document, not a summary or partial translation. This translation should not be performed by a relative. The following text must be included on each translation:

I certify that I am competent to translate from [NAME OF LANGUAGE] to English and that the above [REFER TO DOCUMENT NAME AND APPLICANT] is a correct and true translation to the best of my knowledge and belief. Name: Signature: Address: Telephone: Date:

GENERAL APPLICATION TIPS Contact an immigration attorney, or appropriate government department if you have any questions about completing the form(s). Obtain multiple copies of official records (birth certificate, etc.) Use your full, current name as written on your passport on all applications and documents. Provide supporting documents for any name change for marriage, etc. Include all names that you have used on official records or legal documents under the category "Other names used". Be completely truthful on all U.S. government immigration application forms. If a question does not apply to you do not leave it blank, write N/A Include all pages of a form, whether or not some pages do not apply to you. Include any processing number (if applicable) Include any A-number (if applicable) When including copies of documents or ID do not cut the copied page with scissors. Keep it on the full copied page. Be able to track your mail and be sure it reaches the destination. Be sure to use a proper envelope and postage. Be sure the government address you are mailing to accepts deliveries from your chosen shipping company. You don't need to mail instructions with your application form(s).

APPLICATION PROCESSING It can take months or years for the government to process your immigration application. If you have tracked your application in the mail to make sure it was received, and feel that the process is taking too long, here are some steps you can take: If you submitted a filing fee by check then you can verify with your bank that the check has been cashed. Write a letter to the processing location and ask about your application status. Include detailed information regarding your case. You may choose to contact a lawyer to follow up with the application. Never offer money to speed the process. This is considered a bribe, will cause your application to be denied, and may lead to legal charges.

GLOSSARY OF IMMIGRATION TERMS

"A Number" Accredited Representative Acquired Citizenship ACWIA Adjudication Adjustment to Immigrant Status The alien registration number that the DHS assigns to all applying aliens. Someone who is approved by the Board to represent aliens. He or she must work for a specific, authorized organization. Citizenship given at birth to children born abroad to a U.S. citizen parent(s). American Competitiveness and Workforce Improvement Act of 1998. The USCIS process of processing immigration applications and petitions. Procedure that allows aliens already in the U.S. to apply for immigrant status without being required to leave the U.S. and acquire a visa abroad. If successful, the alien is counted as an immigrant as of the date of the adjustment, regardless of how long the alien has resided in the U.S. Legal permission to leave and re-enter the U.S. during the adjustment of an individual's status procedures. A sworn document provided by the individual in which he provides facts and swears that they are true and accurate. The afficavit should be signed under oath and the signature witnessed by an official, such as a notary public. An individual who has been convicted of crimes identified by the INA. This status creates substantial procedural disabilities. A nonimmigrant class of admission for temporary agricultural labor or services, as defined by the Secretary of Labor. Geographic Area of Chargeability These areas are divided into Africa, East Asia, Latin America and the Caribbean, Near East and South Asia, and the former Soviet Union and Eastern Europe for the preliminary admittance of refugees to the U.S. Officially known as the Permanent Resident Card, identifies the holder as a lawful permanent resident in the U.S. U.S. Immigration and Customs Enforcement.
