FINES AND COSTS SCHEDULE FOR THE 62-B DISTRICT COURT

At a session of the 62-B District Court held in the Kentwood City Center on April 1, 2009

This is the fines and costs schedule established for any violation which occurs after April 1, 2009. If an accident occurred as a result of the violation, the fines will be increased by $20.00. If a serious personal injury accident occurred, the defendant must appear in front of the judge or magistrate. A person responsible for a moving violation in a construction zone, at an emergency scene, or in a school zone during the period beginning 30 minutes before school in the morning and through 30 minutes after school in the afternoon is subject to a fine that is double the fine otherwise prescribed for that moving violation.

Costs upon convictions and guilty pleas other than for parking violations; assessment; disposition; reports Sec. 8381. (1) Until October 1, 2003, when fines and costs are assessed by a magistrate, a traffic bureau, or a judge of the district court, not less than $9.00 shall be assessed as costs and collected for each conviction or civil infraction determination and each guilty plea or civil infraction admission except for parking violations. Of the costs assessed and collected, for each conviction or civil infraction determination and each guilty plea or civil infraction admission, $9.00 shall be paid to the clerk of the district court. (2) The clerk of the district court, on or before the fifteenth day of the month following the month in which costs are collected under subsection (1), shall transmit the following amounts: (a) Until October 1, 2003, the clerk shall transmit 45 cents of the costs collected to the executive secretary of the Michigan judges retirement system created by the judges retirement act of 1992, 1992 PA 234, 1. MCL 38.2101 to 38.2670, and shall transmit $8.55 of the costs collected to the state treasurer. Of each $8.55 received, the state treasurer shall deposit 30 cents in the legislative retirement fund created by the Michigan legislative retirement system act, 1957 PA 261, MCL 38.1001 to 38.1080; $ 4.25 in the court equity fund created under section 151b; [FN1] and shall deposit the balance in the state court fund created by section 151a. [FN2] (b) Beginning October 1, 2003, the clerk shall transmit $9.00 of any costs assessed before October 1, 2003 to the justice system fund created in section 181 of the revised judicature act of 1961, 1961 PA 236, MCL 600.181. (3) Until October 1, 2003, the clerk of the district court shall prepare and submit a court filing fee report to the executive secretary of the Michigan judges retirement system created by the judges retirement act of 1992, 1992 PA 234, MCL 38.2101 to 38.2670, at the same time the clerk of the district court transmits the portion of the costs collected under this section to the executive secretary. (4) Beginning October 1, 2003, when fines and costs are assessed by a judge or district court magistrate, the defendant shall be ordered to pay costs of not less than $45.00 for each conviction for a serious misdemeanor or a specified misdemeanor or costs of not less than $40.00 for each conviction for any other misdemeanor or ordinance violation. (5) Beginning October 1, 2003, when fines and costs are assessed by a judge or district court magistrate in a civil infraction action, the defendant shall be ordered to pay the state assessment required by section 8727 or 8827 of this act [FN3] or by section 907 of the Michigan vehicle code, 1949 PA 300, MCL 257.907. (6) As used in this section: (a) "Ordinance violation" means that term as defined in section 1 of chapter I of the code of criminal procedure, 1927 PA 175, MCL 761.1. (b) "Serious misdemeanor" means that term as defined in section 61 of the crime victim's rights act, 1985 PA 87, MCL 780.811. (c) "Specified misdemeanor" means that term as defined in section 1 of 1989 PA 196, MCL 780.901. 2. 257.601b. (1) Notwithstanding any other provision of this act, a person responsible for a moving violation

in a construction zone, at an emergency scene, or in a school zone during the period beginning 30 minutes before school in the morning and through 30 minutes after school in the afternoon is subject to a fine that is double the fine otherwise prescribed for that moving violation. (2) Whenever practical, signs designed in compliance with the uniform manual of traffic control devices shall be appropriately placed at the construction zone by the state transportation department or road authority having jurisdiction over the construction zone notifying operators of vehicles that for the protection and safety of construction workers the fine for a moving violation in this work area is double the fine otherwise prescribed for that moving violation. (3) As used in this section: (a) "Construction zone" means a designated work area described in section 627. (b) "Emergency scene" means a traffic accident, a serious incident caused by weather conditions, or another occurrence along a highway or street for which a police officer, firefighter, or emergency medical personnel are summoned to aid an injured victim. (c) "Moving violation" means an act or omission prohibited under this act or a local ordinance substantially corresponding to this act that occurs while a person is operating a motor vehicle, and for which the person is subject to a fine. (d) "School zone" means that term as defined in section 627a. MCL 257.627 (9) A person operating a vehicle on a highway, when entering and passing through a designated work area where a normal lane or part of the lane of traffic has been closed due to highway construction, maintenance, or surveying activities, shall not exceed a speed of 45 miles per hour unless otherwise determined and posted by the state transportation department, a county road commission, or a local authority. The state transportation department, a county road commission, or a local authority shall identify on streets and highways under its jurisdiction a designated work area with traffic control devices which are in conformance with the Michigan manual of uniform traffic control devices. A person shall not exceed a speed limit established under this section or a speed limit established pursuant to section 628 or 629. 257.627a. Definitions; speed limit; school zones; application Sec. 627a. (1) As used in this section and section 629: (a) "Regularly scheduled school session" means that part of a day of student instruction which is followed by a break for lunch or by a final dismissal of the student body for that day. (b) "School" means an educational institution operated by a local school district or by a private, denominational, or parochial organization, except an educational institution containing only grades above eighth grade. School shall not include an educational institution which the department of education determines either has its entire student population in residence at the institution or has its entire student population transported to and from the institution by motor vehicles. (c) "School zone" means school property on which a school building is located and the area adjacent to the school property which is designated by the signs required under subsection (2). Except as otherwise provided in

subsection (5), the school zone shall extend not more than 1,000 feet from the property line of the school in each direction. (2) Except as provided in subsection (4), the prima facie speed limit in a school zone, which shall be in force 30 minutes before the first regularly scheduled school session until school commences and from dismissal until 30 minutes after the last regularly scheduled school session, and during a lunch period when students are permitted to leave the school, shall be 25 miles an hour, if permanent signs designating the school zone and the speed limit in the school zone are posted at the request of the school superintendent. The signs shall conform to the Michigan manual of uniform traffic control devices. (3) This section shall not apply to a limited access highway or to that portion of a street or highway over which a pedestrian overhead walkway is erected, if the walkway is adjacent to school property and is designed and located so as to be used, and is being used, as the principal means by which students of a school which has property adjacent to the walkway travel to and from the school. (4) Local authorities may increase or decrease the prima facie speed limit within a school zone under their jurisdiction pursuant to section 629.
