Justin Nicholas Oddo and Sarah Oddo are sworn. 9:09 a.m. This is the time set for Evidentiary Hearing on Temporary Orders with regard to Petitioner's October 12, 2011 Post-Decree Petition to Modify Child Custody, Parenting Time, Child Support and Petition for Prevention of Relocation. Petitioner/Father, Justin Nicholas Oddo, is present with counsel, Susan Pintel. Respondent/Mother, Sarah Oddo, is present on her own behalf. A record of the proceedings is made by audio and/or videotape in lieu of a court reporter.

The Court is informed that Petitioner's Petition for Prevention of Relocation is no longer an issue as Mother is not relocating out of Maricopa County, Arizona. Discussion is held with the Court regarding discovery/disclosure issues. Discussion is held with the Court regarding the appointment of a Custody Evaluator as Ordered by the Court on November 8, 2011. Justin Nicholas Oddo, having previously been sworn, now testifies. Petitioner's Exhibits 1 and 6 are received in evidence. Sarah Oddo, having previously been sworn, now testifies. Based upon the testimony and evidence presented, IT IS ORDERED taking this matter under advisement. IT IS FURTHER ORDERED authorizing Mother to take the minor child to Missouri and Texas for the Christmas holiday, leaving Arizona on December 20, 2011 and returning to Arizona on January 3, 2012. The Court having randomly selected a Custody Evaluator from those presented to the Court by the parties, IT IS ORDERED appointing Larry F. Waldman as the Custody Evaluator in this matter. A separate minute entry shall issue defining the terms of the appointment. There being no further need to retain the exhibits not offered in evidence in the custody of the Clerk of the Court, IT IS ORDERED that the Clerk permanently release all exhibits not offered in evidence to the counsel causing them to be marked, or to their written designee. Counsel shall have the right to re-file relevant exhibits as needed in support of any appeal. Re-filed exhibits must be accompanied by a Notice of Re-filing Exhibits and presented to the Exhibits Room of the Clerk's Office. The Court's exhibit tag must remain intact on all re-filed exhibits. IT IS FURTHER ORDERED that counsel or written designee take immediate possession of all exhibits referenced above. Docket Code 020
