The Jackson Magilbry Family Homestead
Submitted by Lisa R. Franklin Carmichael, Rt 2, Box 273A, Tallassee, AL 36078-9802 The Jackson Magilbry Franklin family home was built about 1890 when Jack married Sallie Lenora Patterson. Jack ( born 28 Apr 1861 Red Level, Covington County, AL died 8 Feb 1934 ) was the son of John A & Mahaley Celia ( Findley ) Franklin. Sallie ( born 26 Jan 1866 AL died 15 Aug 1955 ) was the daughter of George & Margaret ( McIntosh ) Patterson. The Home is located down a dirt road known as "The old Prestwood Bridge Road" just off Plywood Mill Rd on the outskirts of Andalusia, AL in Covington County. Jack bartered 2 oxen & yoke for the 160 acres of land the home was located on! Magilbry is a family name. It was the name of Mahaley Celia Findley Franklin's father. All of Jack & Sallie's eight children were born in the home and when daughter Sarah ( born 1901 ) was eight years old the family built a new home across the road from the old homestead. The new home is where Sarah lives at present. She and her sister Ethel are the only two of Jack's children still living. They celebrated their birthdays this past February, 90 & 83 respectively. They are two wonderful ladies without whose help many parts of my family history would have been forever a mystery. The picture above is that of Lisa Carmichael's Great grandfather - William Jefferson "Bill" Franklin ( born 7 Apr 1856 Andalusia, AL died 3 Mar 1932 Mobile, AL ). Bill was the oldest child born to John A & Mahaley Celia ( Findley ) Franklin and an older brother of Jackson Magilbry "Jack" Franklin. Bill's signature is on the card at the bottom of the photo. The picture was taken about 1880 and is still in the original frame just as it was when hanging in Bill's home. John A Franklin ( born 1827 ) was the son of Wilson Franklin ( born ca 1780 GA died ca 1836 Loango, Covington County, AL ) and Temperance ( ? ) "Tempy" ( born 1788 died ca 1868 Loango, Covington County, AL ). It is a shame that the "Old Franklin homestead" of Tempy & John is not still standing as some of the older folks can tell "tales" of its time. There was even a creek there called "Franklin Branch" that ran along the edge of Tempy's property.

I sincerely hope that everyone enjoyed a wonderful & safe Thanksgiving and Christmas with family & friends. "Happy New Year" to all of our "new found" families. Our potential accomplishments in 1992 are an exciting thought, one I hope everyone will be a part of. Our Charter Issue was mailed prior to the October deadline, at which Johnnye & I were delighted. She drove to El Campo early on Saturday Morning & we spent the entire day putting the finishing touches on the Charter Issue and excitedly discussing future issues - while my husband kept us supplied with nourishment. Johnnye has many wonderful ideas and is truly the force behind my "tail winds" which keeps me from blowing completely off track. We both encourage your requests and ideas as to what you would like to see first in our quarterly. A total of 97 charter issues were mailed to Franklin Researchers scattered across 26 states from Coast to Coast and England. Your response tells us you were pleased with its contents. Inquiries continue to come in from those who are hearing about our United Organization for the first time. If you have names of researchers you think would be interested - please send their names and we will contact them explaining our goals & objectives. But please, we need your research, family group sheets & Pedigree charts. We have a lot of research material to publish but we need your continued research contributions so that we can maintain a geographical balance. Some areas are more important to some than others and we want to publish something for everyone. Our success will depend on everyone's efforts in helping us to get that material out to everyone else. If you live near a courthouse and/or library - please comb through any and all records available for the Franklin Surname. No matter how insignificant to you and submit for publication. Don't give up on us - we will publish your materials! Cover Page for Vol 2 ( April '92 ) will feature the home of Ralph "Rafe" Morris Franklin built about 1900 located near Gum Slough, Jasper County, TX. Ralph is an ancestor of Charter Member #018. He is presently researching with future plans of a book. His ancestor Ralph Franklin & my ancestor Henry Franklin are believed to be brothers. Vol 3 ( July '92 ) cover page will feature "The Lakeside Hotel" in Spring Lake, Minnesota managed by Wm B Franklin and his wife Susan. ( Wm is the ancestor of #048 ). A wonderful write up was submitted with this cover picture. I know you will enjoy it. At present Vol 4 ( Oct '92 ) is open. So if you have a picture you would like to share with us and have featured on the cover of one of our future issues send them along with a write up of the picture. Covers are printed ahead, therefore, your picture will be returned promptly. We encourage you to submit pictures that you can not identify, also. Johnnye & I are contacting other Genealogical & Historical Societies to exchange quarterlies with us in an effort to build our reference library. So if you know of one that you feel will benefit our members let us know and we will contact them.

Hello Cousins, Friends and fellow Researchers, I wish you could all feel the thrill that I get every time Elaine calls or faxes me some of the wonderful letters we have received about the charter issue. It would be wonderful if we could afford to publish all of the great material as fast as it is coming in. I hope every member will find something in their file to share with the rest of us. Don't be afraid to share because at sometime or another you have received negative feed back. That would put you in the same category as the man who never failed because he never tried. If I get negative feed back, it spurs me on to either prove or disprove my theory, therefore working to my advantage, helping me to improve my research. The first week of October I was in Richland, WA. I didn't get to go to the courthouse but I did visit the local library. They had a small genealogy section and I didn't find any FranklinS in any of their publications. They were having their book sale so I brought home some history books, a little beat up but covering areas that I am interested in.

We are going to publish a Franklin Lineage Book to be mailed out by December 10, 1992 in time for Christmas gifts. I hope that everyone will send their charts in to be published as this is a great opportunity to get all of your names in circulation. You don't have to be a member to send in your charts, nor do you have to purchase a book, BUT you do have to be a Franklin descendant. You can get all of your names in by following a format similar to the one I used in the charter issue, or if you want to send each chart, it should have at least seven names on it. If you have already sent Elaine an ancestor chart then we need a letter of permission to publish it. Please be sure that your address is current and readable. Type or neatly print your chart in black ink. If you need a blank chart, send me an SASE and I will be happy to send you one. Be sure it is not a faded copy as a light chart will not copy well. We will publish each chart that has a Franklin or Franklin descendant. Charts must be received by September 1, 1992 and cost of book will be published in October 1992 issue. Send your charts directly to me Johnnye Carlson -1024 Ross - La Marque, TX 77568. I will make a copy of your chart, then send the original to Elaine for our file.
I don't have a book to review this time but I did see one at Clayton that bears looking into. - Some Early Pioneers of Western KY - Their Ancestors & Descendants, second edition 1990 by Helen E. Hart Peyton, 733 Schaffer Street, Charleston, SC 29412. This is a beautifully put together book with at least two pages of Franklin's in the index. Franklin/Cleveland descendants: If you do not have access to the Clevealand/Cleveland Genealogy published 1899, I have all three rolls of film and will be glad to search your names. There is a lot of misinformation in this book, but so many great clues that it is worth the search. Send SASE and twenty five cents for each name so that I can make you a copy of what is there. The charter issue was sent out to 26 states and we would like to know more about all of these areas. If you will send us a copy of your currant genealogy society's quarterly along with a list of what your society has published, we will review it, giving the address for those that are interested. My great-grandmother, Prudence Ann Husband ( born 1828 TN, probably Giles or Lincoln County ). Her father, Mansfield Husband died when Prudence was a baby. Her mother died a few years later. Family tradition says Prudence then lived with her maternal grandparents by the name of Franklin, who were Indians. Prudence Ann Husband married John Mealer at the age of 14. The Family of Lewis Franklin of Bedford & Campbell Counties, Virginia

Edited for sake of space. There is no certain record of Lewis Franklin before he appeared in Bedford County, VA circa 1735. He may have come from Henrico County, VA or more likely, Chester County, PA. Lewis Franklin patented at least three parcels of land in Bedford County, VA; in 1749 850 acres including the head branches of Falling River adjoining Edward Nix's line; in 1756, 118 acres on Callaway's Rd. between the two ridges [map coordinates of this property are N 37° 17' 54" W 78° 59' 57" in present day Campbell County, VA]; in 1759, 215 acres on the south side of Dixon's Creek. This land adjoined the Dixon land grant and was located some three miles southwest of Concord, VA on highway 658 and was owned by the Franklin family until 1945, Charles D. Franklin being the last family owner. On 1 Oct 1751 Lewis Franklin conveyed some of his land to Edmund Franklin, "Jr." by "Deed of Bargain." Lewis and his sons amassed large tracts of land in the area, but as of 1988, all of it has been sold. Lewis Franklin married Jane __? [family tradition says her name was Lewis] She died in 1774 and he died in 1770. They both died and are buried in Bedford County, VA, location unknown. [Reference Bedford County, VA Will Book 1, pages 95-96 for the inventory of his estate and Will Book 1, pages 217-218 for his will]. They had at least seven children, as listed below. The children of Lewis Franklin and Jane ___?: 1. Owen Franklin ( born ca 1740 died 12 Aug 1794 Campbell County, VA ) married Elizabeth "Betsy or Betty" Steele of Concord, VA. He was an ensign in the Revolutionary War; a Captain in the Bedford County Militia, ( joining in 24 Feb 1778 ) and served as deputy sheriff of Campbell County, VA. In 1773 he patented 49 acres of land on both sides of Morton's Creek, a fork of the Big Falling River. In 1778 he bought from Pleasant Branch 182 acres on the south side of Morton's Creek along the line of his brother, Thomas Franklin, from Hall's corner to Harris' corner. [Reference--Campbell County, VA Will Book 1, pages 274-5, dated 5 Apr 1795]. Even though some dates conflict, it is probable that his widow married 12 Apr 1794 in Campbell County, VA, Alexander Steele, Sr., because when her daughter Mary Franklin married William North, Campbell County, VA, 2 Jul 1795, consent was given by Elizabeth and Alexander Steele. The children of Owen Franklin and Elizabeth Steele: order unknown: ( 1 ) Robert Franklin [ Colonel] ( born ca 1760 died Jun 1854 ) married by Rev. Henry Brown in Campbell County, VA 22 Dec 1800 Mary Perrow ( born ca 1780 ) daughter of Daniel Battersby Perrow ( born 1756 died 21 Jul 1839 ) and Elizabeth Perrow ( died 21 Jul 1839 ) ( Daniel and Elizabeth were first cousins ). Robert was a Colonel in the county militia and owned a large estate in Campbell County, VA which included Pilot Mountain. The map coordinates for Pilot Mountain are N 37° 19' 28.01" W 78° 58' 7.76". He died in the influenza epidemic of 1918 and Sallie moved to Lynchburg, VA and she died there. They are both buried at New Concord Presbyterian Church cemetery. Henry Brown and lived on their farm in Appomattox County, VA and are buried there. (9) Kesiah Franklin married in Campbell County, VA 12 Apr 1793 John Wood. Robert Franklin ( born ca 1741 died 9 Dec 1831 ) Bedford County, VA and died in Campbell County, VA. He married ca 1767 Jane "Jennie" Lewis ( born 1756 died 1831 ) when she was 11 years old. Jane was evidently born in Ireland. He owned a large estate near Concord, VA and was a Colonel in the county militia. His sons Lewis and Benjamin were the executors of his estate. They were married by Rev. William Mahon. She was called "Little Old Aunt Letty. "She was small of stature and always wore a black silk bonnet. On Sunday, the bonnet was trimmed with white lace. Thomas was a private in the Revolutionary War and a major in the county militia. He owned a large tract of land ( must have been several thousand acres ) near his father and he built a fine brick home on it. This home was near present day Naked Creek ( some say Aker's Creek ), a branch of the Big Falling River. In 1973 the house was still standing at map coordinates N 79° 00' 30" W 37° 17' 45". Thomas and Letty are buried in a family plot near their home. A cabin on the estate has long since gone to dust; but around it in the fields, flowers that she imported from England still grow. [Reference-Campbell County, VA Order Book #9, page 30 shows an order setting aside her dowry, 237+ acres, taken from the estate of her husband and it was set aside from the land belonging to her son, Henry R. Franklin. Order book #23 speaks of the pension of her husband and that it to be given to her. She made her will 1 Dec 1859 and bequeathed all that was hers to her daughter, Bridget Carson and her two granddaughters, Martha Campbell and Jane Campbell. No issue. Henry always wore a hat with the string tied under his neck. He built in 1847 the fine brick home now ( 1988 ) occupied by the author's sister, Mrs. Harvey Eliot Henderson near Plum Branch, Campbell County, VA. The bricks were made on the farm by slaves and the rock was quarried on Blue Hill about a mile away. An interesting story on the atheist wife was told to the author by Mrs. Pearl Thompson. The atheist had died ca 1889 and had been "laid out" ( prepared for burial ) by several friends. While the body was in the parlor, it ( the body ), sat straight up and gave a loud moan. The exit from the parlor was very quick - the corpse had an involuntary muscular reaction and was really quite dead, but because she was an atheist [in that day and time, not a very nice person], the shock on these religious people was severe! About 1870 Capt. Henry signed a note for a friend who wanted to buy a farm and the friend absconded and Henry lost his farm, which had been debt-free. After he lost his farm, he moved to Lynchburg and lived with his niece, Pearl Franklin ? on Church Street between 10th and 11th Streets. He would sit on the porch and rock and he kept a cane under his chair and if he saw any passerby who had the same name as his friend who has ruined him, he would pound on the porch railing with his cane and call out to the person in a loud voice and tell them that they were descended from a scoundrel. Socrates Haden bought the farm. The children of Henry Franklin were: A. Dr. Joel W. Franklin ( born 1836 died 1866 ) lived in Pamplin, VA. He was highly eccentric and walked from Plum Branch to Oroville, California ca 1955 and he worked for Andrew Hunter Land in the lumber mill there for a time. Presbyterian Church. In their old age, Charley, Willie and Resa lived together and they told their niece, Mary Saunder Jones, that if she would take care of them, she could have the farm. She did until they all died and then she lived there by herself. When Harvey E. Henderson came back from World War II, his wife, Sarah Agnes Evans Henderson asked Mary Saunders Jones if she wanted to sell them some land: she said "No, I want to keep it in the family." About 1947 she sold it to her nephew, Jones Rucker, and he built a large dairy on the farm and after four years, he sold it while Mary was in the hospital with sciatica and it nearly broke her heart. g. He was a farmer and lived at Concord Depot and is listed in the 1860 census of Campbell County, VA as a farmer worth $5000. He then moved to New Florence in the same county, opened his own store which he kept until 1864. In December 1864, he was appointed the railroad agent at Old Allen on the North Missouri Railroad. Three years later the station was moved to Moberly, MO and he continued as agent until 1872. He was then appointed messenger for the United States Express and he ran on the road between Moberly and Ottumwa for two years. In 1874 he was appointed deputy sheriff of Randolph County and was elected constable of Moberly Township which he held for four years. In 1879 he worked as a carpenter and he took charge of the railroad water tank and engine. On 4 Mar 1864 he was married in Montgomery County to Elizabeth P. "Bettie" Pew, daughter of A.D. Pew. They had one daughter, Clara May Franklin. They lived in Moberly and he was a member of the Methodist Episcopal Church South and his wife and daughter were members of the Cumberland Presbyterian church.[Reference- History of Howard and Chariton Counties, MO, page 877. Submitted by Elaine F Giddens, Rt 2, Box 212, El Campo, TX. ( From the beginning of the Texas Revolution, The Republic gave land to veterans. Texas promised to those who fought for her 320 acres for 3 months service, and up to 1280 acres for one years service. These were called Bounties. The State of Texas and Republic of Texas from 1835 to 1888 issued 7,469 bounty warrants for 5,354,250 acres of land.3 In July, 1876 Texas gave a pension of $150 a year to surviving indigent veterans and to the Signers of the Texas Declaration of Independence. After the money ran out land was substituted.4 In 1881 there were many indigent Civil War veterans and widows in Texas. Again the state gave land to these in lieu of money. 1280 acre Confederate Scrip certificates were given to disabled surviving veterans and to widows whose husbands were killed or died in the service. North & South Carolina Marriage Records from the earliest Colonial Days to the Civil War11
"History was dealt sparingly with the early settlements in the Carolinas. The first settlement in what is now North Carolina was in the County named Albemarle, which was divided in the three precincts of Carteret, Berkeley and Shaftesbury. Here were among the first English settlements made in America. In 1663 a land patent and grant was made to Lord Clarendon by Charles the Second of England. Nine years later Charleston was founded and about this time a more ample charter was obtained and the government passed into the hands of the proprietors. This Proprietary Government continued for about 50 years. In 1728 Carolina which at this period meant the North and South sections combined, contained three counties, Albemarle, Bath and Clarendon. Albemarle was divided into the precincts of Currituck, Pasquetank, Perquimans, Chowan, Bertie, and Tyrrell. In Bath County there were four precincts, Beaufort, Hyde, Craven and Carteret. Clarendon had the single precinct of Hanover. At the end of the Proprietary Government these counties and precincts were abolished and became counties of North and South Carolina." was appointed by the U.S. Court of Claims to determine who was eligible for funds under the treaties of 1835-36 and 1845 between the United States and the Eastern Cherokee. Funds in excess of $1 million was appropriated by Congress on 30 Jun 1906. In certifying the eligibility of the Cherokees, Mr. Miller used earlier census lists and rolls that had been made of the Cherokees by Hester, Chapman, Drennen and others between 1835 and 1884. Other enrollment records used by Mr. Miller are among the classified files of the Bureau and are designated as "33931-11-053 Cherokee Nation." He submitted his report and roll on May 28, 1909 and submitted a supplementary report and roll on Jan 5, 1910. Father #315 and claims through same source. #315 Sarah Jane Reece - 4 children, Spring Place, GA R.F.D. 3 - rejected. Applicant claims through father Anderson Green Franklin who was born in SC in 1823 and Gardner Green Applicant's Great-Great Grandfather. Applicant's father is living and has filed application #1774. Neither applicant nor his father nor his grandfather nor great-grandmother were ever enrolled. Although they were living nearby and within the Cherokee County and if recognized as Eastern Cherokees since 1800 or prior thereto, some of them would certainly have been enrolled. They do not establish fact of descent from the Garner Green on the 1835 Roll and even if they did would not be entitled as there are two generations who should have been enrolled in 1835 as they were old enough and were heads of families at that time. See Miscel. Test. p. 2129 ), and according to the testimony of William A Green, App. #37820, Gardner Green had 4 children: Benjamin, Isaac, William and Mossie ( Miscel. Test. p. 2130 ). ( Applicants herein claim only through Benjamin ). Benjamin had the following children: John, James, William and Dicey Boyd nee Green. All of Benjamin's children above named and through whom claims herein are made were living in KY and MO many years prior to 1835, and there is evidence also to the effect that Benjamin himself was living in KY as early as 1808 ( Miscel. Test. p. 2128-9 and p. 2125 ). Benjamin Green was born about 1761, making him about 74 or 75 years old in 1835. ( Miscel Test. p. 2130 ). James Green, the son of Benjamin, the son of Gardner, was born in 1788, making him about 47 years old in 1845. ( Miscel. Test. P. 2130 ). James Green went to MO to live in 1831, and his sister, Dicey Boyd, and his brothers went with him ( Miscel. Test. p. 2128 ). It is claimed that no ancestor was enrolled, with the exception of Gardner Green, and it is claimed that he was enrolled in 1835 at Rocky Creek, GA ( Miscel. Test. P. 2130 ). Applicant #31279 states in her testimony that she saw Gardner Green in 1832 or 1833, when he came to see her grandmother, Susie Smith, who was living in Clinton County, KY at that time and who was Gardner Green's sister. At that time, Gardner Green's sons "were off West" somewhere. She states that Gardner Green went from her Grandmother's house in KY "to Fannin County, GA to make treaty". "He never came back". Gardner Green's sons "did not go to GA with him". ( Miscel Test P. 2129 ). Gardner Green possibly lived in GA in 1835. He was a very old man when he died, some say about 115, others at various ages - from 75 years up, and that he died in 1835 or soon thereafter. Some say that he died in ? prior to 1831 ( Miscel Test P. 2125, p2128-29 ). Applicant #3785 states in her testimony that she was born in 1831 in Boone County, MO and that her mother's name was Dicey Boyd ( daughter of Benjamin ) and was born in KY in 1808. She states that Gardner Green died before she was born. She was born in 1831. ( Miscel Test P 2125 ). Applicant #37912 states that she was born in MO in 1835, her father was James Green, that he moved to MO in 1832 or 1833 with his father Benjamin Green and his brothers John and Isaac and his sister Dicey Boyd ( Miscel. Text. p. 2127 ). Applicant #37890, daughter of James Green, was born in KY in 1829 ( see her application ). There is a Gardner Green on the roll of 1835, enrolled at Rocky Creek, GA with 8 others, making a family of 3, 1 male under 18 years, 1 male over 18 years and 1 female over 16 years, all full-bloods. In an affidavit field herein by Nancy C Martin, she states that Gardner Green, her ancestor, was a full-blood. Affidavit filed by William A Green states that his grandfather, Benjamin, received letters from his ( Benjamin's father, Gardner ) who was living in GA. That Benjamin said that he himself was three-fourths Cherokee. That when Gardner Green died, affiant's grandfather, Benjamin, said that Gardner was buried in the family burying ground east somewhere. It seems extremely unlikely that the Gardner Green on the roll of 1835 was the same person who is claimed as the ancestor of applicants herein, as applicants' ancestor was between 95 and 115 years old in 1835, according to the testimony, affidavits, etc., and had a son Benjamin who was 74 or 75 years old in 1835, and grandchildren as old as 47, and a great grand-child born in 1808. The Gardner Green on the 1835 roll, however, as above stated, was enrolled with a male under 18, who was probably his child, although that is only supposition, it being impossible to ascertain from the roll, the relationship of persons in any one family group. Some of the applicants herein in their testimony also state that their ancestor, Gardner Green, died prior to 1835. From the above it appears that Benjamin Green and his sons, John, James and Isaac, and his daughter Dicey Boyd, were living in KY and MO long prior to 1835 -that they had left the Eastern Cherokee tribe, if they ever belonged to it, long prior to the treaty of 1835-6, and if Cherokees at all, should be classed as Old Settlers. Even conceding that the Gardner Green on the roll of 1835 is the same person who is claimed as the ancestor of applicants herein, they would not be entitled, because Benjamin Green and his children who were the ancestors of these applicants, and through whom they claim, were all heads of families in 1835, and if members of the tribe and living in the Cherokee domain at that time, should have appeared on the roll of 1835, and if living as far off as MO and KY, could not have been considered members of the tribe at that time. was, as above shown 74 or 75 years old in 1835. James was about 47, Dicey Boyd was 27, and the two other boys, John and Isaac, although it is impossible to ascertain the exact date of their births, were probably older than Dicey as they were always named before her in applications, affidavits, etc. Dicey Boyd was born in KY in 1808, showing that Benjamin, the son of Gardner, was living in KY as early as that date, which was hundreds of miles from the Eastern Cherokee domain. From KY Benjamin and his sons and daughter and their families moved to MO so that if they ever lived with and were members of the Eastern Cherokee tribe, they left it at least prior to 1808 and never lived or had any connection with it again. Wherefore, in consideration of the premises, the claim of all persons claiming through Gardner Green, Benjamin Green, and the latter's sons and daughters, are hereby rejected. ( Miscel Test p 2122-3-5-6-7-8-9-30 and 2038. See also affidavits and letters filed in the case ). #3040 John B Franklin & 4 children, Wesser, NC Rejected. Cousin #126 and claims through same ancestors. #126 Anna R Cothran & 3 children, Topton, NC Rejected. It does not appear that ancestors were ever enrolled or were parties to the treaties of 1835-36 & 1846. They show no real connection to the Eastern Cherokee. ( Miscel Test. p 1550 ).
#2249 Wm E Franklin & 5 children, Dalton, GA Rejected. Brother of #315 and claims through same source. #3384 Norman Franklin & 2 Children, Atmore, AL Rejected. Creek Case ( See Special Report #1139 ) #1139 John F McGhee , Atmore, AL Rejected. There are several hundred persons who have filed applications for participation in the distribution of the Eastern Cherokee fund, who for the most part, live in the extreme southern section of Alabama and the western section of Florida, who are not Cherokees at all, and most of them do not claim to be Cherokees, but are Creeks. Quite a number of these claims decent from such historic Creek characters as Billy Weatherford, Peggy Bailey, William and Chilly McIntosh and Alexander McGillivray, and most of these applicant's claim only through the Hollinger, McGhee, McIntosh, Meniac, McGillivray, Franklin or Killiam families, which are all of Creek Origin. Some of these are recognized members of the Creek tribe, others while not recognized as members of the creek tribe, claim as descendants of some Creek ancestor. Most of them state in so many words in their applications and in their testimony that they are Creeks, and they file their applications under the impression that descendants of Creek Indians are entitled to share in this fund. This idea was spread in certain sections of the South by some attorneys and claim agents, who were themselves under the impression that Eastern Creeks are entitled to share in this fund. Powers of Attorneys have been received by the Special Commissioner, which provide for the payment to attorneys of a certain percent of any money recovered from these claims of "The Eastern and Emigrant Creeks". There is absolutely no connection between any of these claimants and the Eastern Cherokees and no such connection is claimed by them. They never lived within the Cherokee domain. They were filed under the erroneous opinion that this fund was for Eastern and Emigrant Creeks instead of Cherokees. These cases have all been grouped together and for convenience marked "Creek file." As they are not in any way connected or related to the Eastern Cherokees, and as most of them do not even claim to be so connected and related, of course none of them were ever enrolled with the Eastern Cherokees, nor were any of their ancestors parties to the treaties of 1835-6 and 1846. For particulars see "Creek Testimony" pp 1-12, taken Feb 1908. For the reasons above stated, all of these cases ( in what is marked the "Creek File" ) are rejected.

Johnnye & I attended the 1991 TSGS Annual Conference held in Austin on Nov 16 & 17. If you are not already a member of the Texas State Genealogical Society, Rt 4, Box 56, Sulphur Springs, TX 75482 we encourage you to become a member. They publish an excellent quarterly. I felt the following information which was presented by Desmond Walls Allen, Arkansas Research, PO Box 303, Conway, AR 72032 during one of the workshops, might help those of you that might not know of this Research tool, and to perhaps serve as a reminder to those more experienced researchers.
Locating Land Entry Case Files in Public Domain States
Public Domain States: Are all the States except the 13 Original Colonies, Maine, Vermont, West Virginia, Kentucky, Tennessee, Texas & Hawaii. Kentucky & Tennessee lands were used by Virginia & North Carolina for Bounty Land for military services. Texas was an Independent Republic and came with its land intact as did Hawaii. Therefore, locating Public Domain Land Entry Case files pertains to 30 Public Domain States that were in the jurisdiction of the Federal Government. The Federal Government acquired the land: As the Federal Government acquired lands ( i.e. The Louisiana Purchase ) the first thing the United States had to do was acquire a title. A Survey was needed: The system imported from England to survey the land was ( 1 ) Leaps & Bounds ( also referred to as discriminate surveys. Leaps & Bounds surveys quite often named the neighbors. Since this method was not tied to some larger survey it is difficult to make exact location on the map. Also it is difficult to rebuild the land description. Survey Field notes: were made by the surveyor who went out with their equipment and surveyed the Public Domain Lands. These field notes still exist. If your ancestors lived on the land at that time ( Surveys came after settlement in a lot of places ); your ancestors may be mentioned in survey field notes. All Previous Claims had to be settled: After the survey was made all previous claims to land, including people who where already in the area, had to be settled. Local land offices were set up: The Federal Government established local land offices and sales, to private individuals, began of the land. All the paperwork was sent to Washington. Therefore, these records were not

destroyed by fires. Land Patents were issued: Land patents were issued to buyers. The documents issued to the buyer stated that the buyer now owned the land and the buyer may or may not have recorded their land patent locally in the County Deed Book. When researching these recorded land patents be sure that you are researching the correct county at the time the patent would have been recorded. Tract Books were large volumes set up and recorded, by land description, transactions involving a particular piece of land. Township plats were diagrams of Public Domain Lands that were divided up showing Rivers or natural features that were on the land. They may also have notes about earlier settlers. Land Entry Case Files consist of Paperwork that was created when our Ancestor bought the land or otherwise acquired the land ( i.e. Homestead ) . In 1862 the Federal Government passed an Act that said "If you will live on the land and fulfill certain requirements about improving of that land, we will give you the land." These files are located in Suitland, Maryland. To obtain the Land Entry Case File: The seven states indexed include: ( pre-1908 ) Alabama, Alaska, Arizona, Florida, Louisiana, Nevada & Utah. For these states send: State, full name, county - to National Archives, Washington, DC 20409. Wait for instructions and pay when instructed to do so. For unindexed states send legal description of land to: Bureau of Land Management, 350 S Pickett St., Alexandria, VA 22304. Ask for: land office name, type of file ( cash purchase, Credit or Homestead ) and file number. After you receive a reply then write National Archives, Washington, DC 20409. If you do not have the legal land description ( Section, range & township ) these can be gotten from County deed records, Historical Atlas, Tax Records or Tract Books. Good Luck!

He has a great deal covering his allied lines which has not been included with this information. Sarah Sally Ann Franklin ( born 5 May 1799 VT died 27 Dec 1851 Warren County, IN ) married abt 1820 Allegheny County ( ? ), NY to Lewis Elijah, II ( born 17 Nov 1794 Delaware County, NY died 6 Nov 1856 Warren County, IN buried Mt Ayr, Newton County, IN, North Star Cemetery ) In my research it was mentioned that Sarah's last name was possibly "Brady". With the help of other genealogists, nowhere is the name Brady found. We believe from the following records that Sarah is the daughter of Vial Franklin ( born 1744 ) and Mrs. Lucretia Whitney Franklin ( born 1771 ). Fellow family genealogist: Wayne Bonner, 15619 Ogram Ave., Gardena, CA 90249, has supplied the following information: Sarah Franklin was born in Vermont in 1799 which would have made her 51 in the 1850 census as indicated. It would be more than a coincidence if Sarah Brady and Sarah Franklin had been born the same year in the same state, but it is possible of course. I believe that at the time of the 1850 census, at least, Lewis Elijah's wife must have been Sarah Franklin. The Franklins did live in Andes, Delaware County, NY as indicated by the 1820 census. ( Vial Franklin & Lewis Elijah are enumerated on the same sheet ). Lucy Barlow, another of the Franklin daughters, lived in Andes in 1820 and 1830, and Lewis Elijah #2 is enumerated only two lines down from Vial Franklin and immediately before Benjamin Franklin on the 1830 census of Allen Twp. Allegheny County, NY. We therefore seem to be able to associate the Franklin and Elijah families from at least 1820 to 1830 and again in 1850. Perhaps all of these are by coincidence, but it seems very unlikely to me. Below are the locations of the Vial Franklin family as listed on the federal censuses: 1800 Grafton, Windham County, Vermont, pg 598 1810 Easton, Washington County, NY pg 494 1820 Andes, Delaware County, NY pg 44 ( Lewis Elijah also on this page ). 1830 Allen, Allegheny County, NY pg 21 ( Lewis Elijah #2 on pg 22. 1840 Allen, Allegheny County, NY pg 216 ( After checking these references, I conclude that Sarah Franklin is the wife of Lewis Elijah. Meshack Franklin attended the University of MS at Oxford for three years and graduated in Jun 1860. He enlisted in the Confederate army in May, 1861, in the University Grays of Oxford, Company A, Eleventh Mississippi infantry, commanded by Colonel Moore, and went direct to Harper's Ferry. His first engagement was the first battle of Manassas, and soon after that he was detailed as assistant commissary sergeant, serving in that capacity until the close of the war. In Jan 1865 he obtained a furlough and came home. He was at Grenada, MS on his way back when the surrender came, and went from there to Memphis where he was paroled in June, 1865. He then returned to his home and the following year went to Hardeman County, TN where he taught school for a year. Returning to Marshall County again he resumed the occupation of farming, and in May 1866 was married to Miss Julia P Wilburn of Fayette County, TN. Their marriage has been blessed with the birth of five children: Wilburn B., James H., Mattie E., Julia A and Meshack. Mr. Franklin owns one thousand three hundred acres of land, a nice two-story frame residence situated one mile east of Early Grove, and about eight hundred acres under cultivation, the greater portion of it operated by tenants. The principal crops are corn and cotton, and of the latter his farm yielded one hundred and fifty bales in 1890. He has a steam gin on his place, and the number of bales ginned annually are about three hundred. Mr. Franklin is a member of the Masonic fraternity, Knights of Honor and the Farmers' Alliance. He was magistrate for four years, was a member of the board of supervisors for the same length of time, and is well and favorably known all over the county. He and Mrs. Franklin are members of the Methodist Church South, and move in the best circles of society. Robert L Franklin was brought up to the life of a planter by his father John A Franklin, and like the majority of boys, has followed in his ancestor's footsteps, and is now one of the leading agriculturists of Clay County. He was born in Pickens County, AL in 1841, a son of John A and Seleta C Franklin, the former of whom was born in NC in 1814. When about twenty-three years of age he married to Seleta Stell, a daughter of George and Elizabeth Stell of AL. To Mr. Franklin and his wife eleven children were born: Elmyra ( Mrs.

John A Franklin came with his family to MS in 1843, and settled at Ripley in Tippah County, but afterward moved to Itawamba and finally to Noxubee County where he died in 1859. His widow survives him and resides at Hamburg, AR in her seventieth year. The father was a member of the Masonic fraternity, which he joined in Itawamba County and upon his death in Noxubee County was buried by that order. He was as is his widow a member of the Baptist Church. Robert L Franklin received a common school education and at about the age of twenty-five years began to make his own way in the world. In 1865 he was married to Miss Anna Goldson of Oxford County, MS a daughter of William D and Permelia A Goldson, and their union resulted in the birth of ten children: Minnie A ( Mrs. Milton ); Mary E; Edith C ( Mrs. Jones ); Willie L; John B; Charley A; Julia S and Mattie L being the only ones now living. Upon the opening of the war in 1861, he became a member of Company H, Fifth Alabama Regiment, under Jackson, and fought at the battles of Seven Pines, Yorktown, the seven days' engagement at Richmond, Chancellorsville, Bull's Run, the first and second Manassas, Sharpsburg, Petersburg and Fredericksburg. He was wounded at Malvern Hill, and lay ten days in the hospital at Richmond, and at the battle of Chancellorsville he lost his left arm from a rifle shot. After remaining in the hospital for some time, he was honorably discharged from the service and returned to his home, where he has since devoted his attention to planting, and has done well. His plantation is a fertile and admirably conducted one and is situated on a beautiful prairie, and he has the consciousness that it was obtained through his own endeavors, and not from inheritance. He is an enterprising and industrious planter and has proven himself a good manager.
