The Family Education Rights and Privacy Act of 1974 (FERPA) requires us to ensure that a student's right to privacy is protected. Undergraduate Terms and Conditions

1. ELIGIBILITy: A person must be enrolled as a degree-seeking student to be eligible for oncampus Housing. Family housing is not available. The Director of Housing or designee may permit, solely within his/her discretion, students enrolled in continuing education, dual degree programs, or other students with special circumstances to be eligible for on-campus Housing. On-campus Housing may be denied for cause or lack of space. Florida law requires individuals enrolled in a postsecondary educational institution to provide documentation of vaccinations against meningococcal meningitis and hepatitis B unless the person or the person's parent or guardian (if the person is under the age of 18 years old) declines the vaccination by completing a separate waiver for each of these vaccines. Each student must submit his/her vaccination information to University Health Services prior to checking into Housing. Students should visit the University Health Services website for more information: Please contact University Health Services for more information at: MMC 305-348-2401 or BBC 305-919-5675. 2. TERMS OF THE AGREEMENT FOR FALL AND SPRING SEMEMSTERS: Subject to earlier termination as provided in this Agreement, THIS AGREEMENT IS FOR BOTH THE FALL AND SPRING SEMESTERS OF THE 2012-2013 ACADEMIC YEAR, or any portion of the Fall and/or Spring Semester remaining when this Agreement is signed. The current academic year is based on the FIU 2012-2013 Academic Calendar located at The student will be assessed all fees for the entire term if the student enrolls but does not occupy the assigned unit and has not canceled pursuant to the terms of this Agreement. The student shall not be released from this Agreement due to lack of financial resources, dietary, non-emergency medical needs, or dissatisfaction with the room or roommate assignment. 3. COMMUNICATION WITH THE STUDENT: Notification will be accomplished through the use of the student's assigned official FIU student email account. It is the student's responsibility to activate their FIU email account when they receive their Panther ID. Emails regarding Housing will be sent to the FIU email address only. 4. HOUSING FEES AND MEAL PLAN: The student will be responsible for the Housing fee once notified of being assigned to a Housing space via the official FIU student email account.To access the PantherMail account, visit The fee schedule is located at housing., which is incorporated by reference. The Housing fee is based on the assigned unit and can be adjusted if a transfer to another Housing space with a different rate has been approved in writing. Residents in Panther Hall and Lakeview Village have a set room and board plan. As such, these residences are required to participate in the University's dining meal plan program for the full academic year at the rate $1769.00 per semester, The cost of the meal plan is included in the Panther Hall and Lakeview Village on-campus Housing rate. The cost of the meal plan is nonrefundable. If the student is assigned a unit that requires a meal plan but transfers after a term begins to a unit that does not require such a plan, the student is obligated to pay the meal plan for the balance of that semester. Residence in a facility apart from Panther Hall and Lakeview Village does not require participation in the University's dining program, but students may participate for an additional fee. 5. PAyMENT OF FEES: The student shall promptly pay all fees when assessed. It is the student's responsibility to routinely check his/her balances on their "MyFIU" student account to determine outstanding balances. In the event of unforeseen occurrences, additional fees may be assessed. Housing and meal plan fees, if applicable, will be assessed per semester. The Housing Office accepts checks, certified checks, money orders, and traveler's checks drawn on a United States bank with sufficient funds. Cash is not accepted. A. Fees must be paid by the due date listed on the Housing invoice and the Housing website. The dates included in the Housing invoice and on the Housing website supersede any due dates for paying the Housing invoice which may be listed in the "MyFIU" account. Failure to pay fees when due shall be considered a breach of this Agreement and may result in one or more of the following actions being taken: 1) denial of Housing services; 2) loss of space; 3) inability to register for classes; 4) withholding of University records or diploma; and/or 5) turning the matter over for collection. B. A late fee of $25.00 will be assessed for any payment which is not received when due. C. Deferment of fees may be granted provided the official notification of financial aid award shows one or more of the following in an amount sufficient to pay for tuition, fees, and Housing from one or more of the following: 1) Pell Grant; 2) Supplemental Educational Opportunity Grant; 3) FIU Grant/Scholarship; 4) Stafford Loan; and/or 5) Florida Prepaid College Program. Deferment requests are subject to approval by the Associate Director of Housing or designee. If a partial deferral is approved, the student is responsible for paying the balance due in full prior to occupancy. If a deferral request is denied, the student must make payment by the payment date published in the Housing invoice and on the Housing website to guarantee Housing. D. If a student fails to pay by the due date, the student will forfeit the assigned unit but remains financially obligated for all Housing fees. E. If the University is forced to turn the account to collections, the student shall be responsible for all additional costs of collection including attorneys' fees and all costs at all judicial levels (e.g., trial and any appellate courts), if applicable. 6. PROCESSING FEE AND REFUNDS: The $100.00 Housing processing fee is non-refundable and non-transferable. Financial aid may not be used to pay the required processing fee. A. If the student has been approved for a cancellation in accordance with this Agreement, a pro-rated portion of the prepaid Housing fees will be refunded. The pro-rated portion of prepaid Housing fees will be calculated from the first official published check-in day to the day the student checks out of the assigned Housing unit. In addition, any portion of the meal plan not used by the student will be added to their prorated rate. There are no prorations or refunds made after the end of the sixth week of classes. The check-in dates for each semester are posted on the Housing website. B. No refunds shall be made after the end of the sixth week of the applicable semester. 7. ASSIGNMENTS: Assignments are made by the Housing Office without regard to race, religion, national origin, sexual orientation, age, disability, or any legally protected status. Adapted Housing is available upon advanced written request and availability. 8. CHECK-IN/CHECK-OUT: The student may check-in to the assigned Housing unit on the published check-in day and is entitled to remain there until 24 hours after their last day of examinations for the Spring Semester or latest by noon on the last day of exams week listed in FIU 2012-2013 Academic Calendar unless this Agreement is terminated earlier in accordance with the provisions of this Agreement. The published checkout date is posted on the Housing website. A. If the Agreement is terminated, the student must vacate the assigned Housing unit within the time provided in the notice of termination and follow all check-out procedures prescribed by the Housing Office. B. Students with the Fall 2012­Spring 2013 Agreement may occupy the assigned unit during the winter break period from December to January only if all fees for the Spring term have been paid when due. Students who have signed this Agreement for the Spring semester only can move in during the Spring check-in dates published on the Housing website. C. When a student moves out of a Housing unit, the student must schedule a check-out appointment with the Resident Assistant or complete an Express Check-Out. If the student uses the Express Check-Out option, he/she waives the right to appeal any assessment related to the check-out process. D. Failure to follow established check-out procedures will result in a non-refundable $100.00 improper check-out fee. E. Belongings/personal items left behind by a student after the check-out deadline will be considered abandoned property. Any item(s) remaining in the student's unit after checkout will be discarded. Housing and Residential Life staff are not responsible for belongings/personal items left behind. F. A student wishing to check-in early or check-out later than the published dates must obtain written approval from the Housing Office. Approval is based on availability. The student who is approved to check-in earlier or check-out later will be charged a pro-rated amount based on the number of days multiplied by the unit type's daily rate. The student who is not approved for early check-in or late check-out but checks in early or checks out late will be assessed a daily fee of $100.00. G. The student planning to check-in after the designated check-in periods is required to notify the Housing Office of their late arrival. H. It is the student's responsibility to check their "MYFIU" account four weeks after their check-out date to ensure all Housing fees posted have been paid. I. A student is under a contractual obligation to pay all assessed fees. 9. CHANGES IN ASSIGNMENTS: A student may not change Housing assignments without following established procedures and obtaining prior written approval from the Housing Office. A. No changes in assignments will be made based on age, race, religion, national origin, disability, sexual orientation or any legally protected status except as needed to provide a reasonable accommodation to a disabled student. B. Failure to follow established room transfer procedures will result in a $100.00 improper transfer charge and the requirement to move back to the originally assigned unit. C. The Housing Office reserves the right to require changes in room assignments including, but not limited to, consolidation, insure maximum utilization of space and resources, address roommate problems, unforeseen events, enrollment fluctuations, physical facility problems, staff changes, emergency evacuation and shelter purposes, etc. 10. USE OF THE ASSIGNED UNIT: The student is not permitted to assign or sublease, or allow the use of the assigned space by another person and/or guest. A. Guests/visitors must observe all published rules and abide by the registration policies. The student is responsible for the conduct and actions of their guest. No overnight guests are permitted without prior written approval from the Residence Life Coordinator. B. The assigned unit may not be used as a place of business, nor may a student conduct any business within the Housing facility. C. No animals or pets are permitted at any time with the exception of fish in a maximum tank size of ten gallons. D. The student shall use the space only for lawful purposes. E. No smoking is permitted within the Housing units or on campus in accordance with University regulations. F. The student is prohibited from possessing items considered to be health and safety violations (such as candles, incense, halogen lamps, etc.) as set forth in the Student Handbook and/or latest online version of the Student Handbook and/or the Housing website.


11. BEHAVIOR AND CONDUCT: The student agrees to abide by all University, Housing and Residential Life rules, policies and procedures published in the current Student Handbook, the Florida Statutes, the FIU regulations, and this Agreement. The student agrees to conduct him-/herself in such a manner as to allow others the quiet enjoyment of the facilities. A. Any behavior or conduct which: 1) intimidates, threatens, or personally abuses another Resident/Staff, 2) is disruptive to the residential community, 3) compromises the safety and security of the community, or 4) is intended to cause a roommate to move out is a violation of this Agreement will be grounds for immediate removal from Housing and/ or interim suspension by the Vice President for Student Affairs or designee, pursuant to the student code. B. The student whose Housing Agreement is terminated for behavioral misconduct shall forfeit all Housing fees. 12. CARE OF FACILITIES AND FURNISHINGS: A. The student is responsible for maintaining the assigned unit in a clean and sanitary manner, and free from damages. Due to the South Florida climate, air conditioning thermostats must remain on low setting or between 72-78 degrees at all times. No housekeeping is provided. Trash removal is provided from designated locations in each Housing complex. Pest control services are provided to each Housing facility once a month. The student is expected to report damages and necessary repairs to the Residence Hall Complex Area Office. Housing and Residential Life does not guarantee the availability of parts and services. B. The student agrees to cooperate with roommates in the common protection of property, to refrain from modifying the space in any way, except as expressly permitted in writing by the Housing Office, and to promptly pay all assessed charges for damages, special cleaning or maintenance resulting from misuse or modification of the facility. The student is jointly and severally liable with his/her roommates for charges assessed due to a violation of this section, including damages occurring in the unit or in the common areas. C. The student shall be required to inspect and inventory the contents of each Housing unit at the time of check-in and check-out. Each student shall be responsible for the condition of the unit's furnishings. D. All furnishings shall remain unaltered and in their designated unit. Students are not allowed to use their own personal mattresses. 13. UTILITIES: A. The Housing Office reserves the right to assess additional charges based on excessive utility consumption, or as the result of increases in rates charged by the utility service providers. B. All units are provided with Ethernet connection and basic cable television services without additional cost. Emergency call buttons are provided in the units in Panther Hall, University Towers, Everglades Hall, and Lakeview Village. Local telephone service is provided in Bay Vista Housing and University Apartments. 14. INSPECTIONS OF AND ACCESS TO THE UNIT: Facilities are subject to periodic health and safety inspections. Employees and agents of the University shall have the right to enter student's unit at any time: (a) without notice, when an emergency exists, (b) when the student or Housing and Residential Life staff has requested service for the unit for maintenance or housekeeping purposes, or (c) with 24 hours' notice. 15. SECURITy AND KEyS: The student agrees not to duplicate any keys assigned or give their keys to another person. If keys are not returned at check-out, the student agrees to pay the cost for all lock changes and key replacements. The student is responsible for securing the assigned unit at all times and taking such precautions as are necessary to guard his/ her safety and property. Housing facilities are routinely patrolled by the University police force but the University cannot guarantee the safety and security of the student or his/her property. 16. EVACUATION PROCEDURES: The University retains the right to use the residence hall facilities for emergency shelter purposes. If a residence hall is evacuated because of an emergency, only those students deemed eligible by University policy will be permitted to occupy space in a designated shelter. 17. CANCELLATION OF AGREEMENT: To request the cancellation of this Agreement, the student must submit a cancellation request form to the Housing Office indicating which of the conditions set forth in this Section applies and provide any required documentation noted below. Cancellation request forms can be obtained either from the Housing Office or the Housing website. If the cancellation request is based on non-enrollment for a given semester and the student thereafter enrolls for that semester, the cancellation will be null and void and the Agreement is reinstated, obligating the student to pay all assessed Housing fees. A. This Agreement may be canceled if any one of the following conditions is met: 1) The student withdraws from the University; 2) The student participates in an academic program that requires residence outside the Miami-Dade/Broward area (documentation is required); 3) The student is dismissed or suspended for academic reasons; 4) The student graduates and does not continue as an enrolled student in another program; or 5) The student gets married after signing the Housing Agreement (documentation is required), 6) the student has an emergency medical condition that was not pre-existing when the agreement was signed, (documentation required; see Housing website); or 7) Student will be taking only on-line courses and will not be physically attending classes on campus.

B. The University will assess a fee for all approved cancellations of this Agreement and any fees in accordance to this Agreement. Approved cancellations for Fall/Spring will be assessed a $100.00 fee if canceled by July 2, 2012, and $200.00 if canceled between July 3 and August 19, 2012. Approved cancellations for Spring will be assessed a fee of $100.00 if canceled by November 2, 2012, and $200.00 if canceled between November 3, 2012 and January 6, 2013. Approved cancellations for any semester on or after the first day of classes are subject to a $500.00 cancellation fee. C. A cancellation fee will not be assessed to graduating students, visiting international, and national academic exchange students who cancel by July 2, 2012 for Fall/Spring and by November 2, 2012 for the Spring semester. The cancellation fee will not be assessed to the first-time applicant for Housing with approved cancellations that have not yet been assessed on-campus Housing charges. D. If the Director of Housing or designee denies the cancellation request, the student is obligated under this Agreement unless the student chooses to buyout the Agreement by submitting a buyout option form to the Housing Office. The student may buyout the Agreement for a flat rate of $2000.00, If the student requesting the buyout lives in Panther or Lakeview, the student will also be responsible for paying any portion of the meal plan which they have used. The buyout option can only be utilized up to the six week of a given term. E. No cancellations shall be made after the end of the sixth week of the applicable semester. 18. BREACH OF AGREEMENT: Violation of any term, covenant or condition of this Agreement shall be considered a breach of this Agreement. In the event of such a breach, the student shall be notified in writing by the Director of Housing or designee. Remedies for breach of this Agreement include, but are not limited to, denial of Housing services, University disciplinary action, reassignment to another unit, or termination of this Agreement. The decision of the Housing Director will be final. 19. TERMINATION OF THE AGREEMENT: A. This Agreement may be terminated for cause upon the giving of no less than 24 hours advance written notice (by FIU campus email) to the student. In the event of such termination, the student shall check-out of the Housing unit within the time provided in the notice. The University shall also have the right to cancel this Agreement for any cause it deems reasonable including, but not limited to, violations of any provision of this Agreement or the University's policies, rules or regulations. B. A student who withdraws from classes during any semester must notify the Housing Office and vacate the assigned Housing unit within 24 hours following his/her withdrawal from the University. 20. LIABILITy: To the extent authorized by applicable law, the University shall not be liable for damage to or loss to persons or personal property as a result of fire, theft or any other cause whatsoever, or failure or interruption of utilities. The University does not provide any insurance coverage for the students' personal property. The student is strongly encouraged to secure his/her own health and personal property loss insurance. 21. ENTIRE AGREEMENT; NO ORAL MODIFICATIONS: This Agreement sets forth the entire agreement between the student and the University, and supersedes and renders null and void any and all prior or contemporaneous oral or written understandings, statements, representations or promises. This Agreement may not be modified or amended, and no provisions of this Agreement may be waived, unless such modification, amendment, or waiver is contained in a written document executed by both parties hereto. 22. HOUSING FEE APPEALS: In order to appeal a housing fee (with the exception of the denial of the cancellation of the Agreement) , students must follow the guidelines below explicitly. A. Any appeal made must be done in writing, accompanied by supporting documentation, and submitted to the Director of Housing or designee no later than 30 days after the fee was assessed. If a student fails to file an appeal within this deadline, the student's right to an appeal is deemed waived. Appeals not in this format and/or that do not include supporting documentation will be rejected and will not be considered. The student will be notified (via FIU student email) of the outcome of the appeal within 14 days upon Housing's receipt of the appeal. B. The decision of the Director of Housing or designee regarding the appeal is final. There are no further appeals IT IS THE STUDENT'S RESPONSIBILITy TO REVIEW THE STUDENT'S HOUSING NEEDS AND FINANCIAL RESOURCES BEFORE SIGNING THIS AGREEMENT. THIS AGREEMENT OBLIGATES THE STUDENT TO PAy ALL ON-CAMPUS HOUSING FEES AS STATED ABOVE. By SIGNING THIS AGREEMENT, THE STUDENT ACKNOWLEDGES THAT HE/SHE HAS READ THE TERMS AND CONDITIONS LISTED ABOVE AND AGREES TO ABIDE AND BE LEGALLy BOUND By THEM. PLEASE SIGN THE FIRST PAGE OF THIS AGREEMENT WHERE INDICATED. THE STUDENT SHOULD MAINTAIN A COPy OF THE AGREEMENT TERMS AND CONDITIONS FOR HIS/ HER RECORDS.
