POSITION TITLE: Staff Attorney DEPARTMENT: Legal Department REPORTS TO: Chief Legal Officer POSITION GOAL: Provide in-house legal services including representation and research. ETHICS FOR THE PARALEGAL by: Caren Mansfield, a member of the Illinois Paralegal Association We are continuing our review of the Illinois Paralegal Association's Code of Ethics. We are up to Rule Six. If you have not been following this discussion please visit the IPA website to review the Code of Ethics. Let's look at Rule Six. Wow, this is another big one. Confidentiality. Yes, it is important to understand that we can NEVER use information received about a client or a client's case to the disadvantage of the client. We cannot use information received from a client to benefit ourselves. What do I mean by "benefitting ourselves". For example, suppose I talked with a client and learned that real estate prices would be soon rising in a certain area. I could not immediately purchase real estate in the area to benefit from a later sale for more than what I paid. You get the picture. Basically, Rule Six reminds us that we cannot reveal ANY information we have obtained from a client other than if there is a life threatening situation, if we are under court order or if the client gives us permission to reveal information. Many times I have been asked about newspaper articles which indicate our firm represents a client. I usually profess ignorance (I don't always have time to read the newspaper) and simply state I cannot talk about the case. In social situations I sometimes meet a client when I am with my spouse. I simply introduce the client without mentioning the individual is a client of the firm. I have had a client's mother call and want to ask questions about the client's case. In such a situation I try to gently refuse to provide information including even if the individual is a client. It is best not to talk about client cases with a client or members of your firm in public areas, elevators, etc. because you never know who might be listening and understand what you are discussing. The best policy is to seal your lips and not discuss clients outside the firm. Moving right along to Rule Seven we see that it covers communications with non-clients. Here is another important rule. First, always identify yourself as a paralegal to avoid any misunderstanding that you are a lawyer. Rule Seven basically directs paralegals to conduct themselves professionally in all situations involving judicial contact, contact with opposing counsel, and contact with any other individual through the course of a transaction or case. If we take the high road and always behave impeccably there will be no problem. Given we are all human occasionally we fail to behave impeccably. If this does happen to you, make amends immediately by notifying the supervising counsel of any lapse in conduct. This rule would also apply if as a paralegal part of your duties include preparing discovery and the client provides information either admittedly is false or you believe may be false. Disclosure should be made immediately to supervising counsel. Failure to do so could result in serious consequences later. Paralegals having contact with witnesses or opposing clients should recall that some witnesses cannot be contacted directly. A party who the paralegal knows is represented by counsel cannot be contacted directly. If you find out upon contacting a party that he or she is represented by counsel and you were unaware of that fact then you must end the conversation as quickly as possible and once again, notify the supervising attorney. It is difficult to summarize the Code of Ethics rules in short paragraphs because there are so many variables in real live. It is always best to use common sense, keep every interaction very professional and in all "ify" situations, touch base with your supervising attorney. Stay tuned for the final rules next week. National politics have a way of interjecting themselves into the workplace as an election year gathers steam. In contrast, office politics, as played out among coworkers, know no season. And a recent survey suggests they may be necessary for career advancement. More than half (56 percent) of workers interviewed for a Robert Half survey (http://legal.rhi.mediaroom.com/index.php?s=421&item=1368) said involvement in office politics is at least somewhat necessary to get ahead. With this in mind, here are some suggestions for being a skilled politician at work: Build a broad coalition. Ambitious professionals are often focused on earning the goodwill of the presumed power brokers in their firm. While that can be an important advancement strategy, you shouldn't overlook those at the grassroots level. You never know who could cast a deciding vote for or against you. Focus on earning the respect and trust of all your colleagues by being cordial to everyone, sharing credit for successes and delivering on your promises. Avoid "mudslinging." Don't damage your credibility by taking the low road. When you're upset or frustrated, wait until you've cooled off to air your thoughts. Be direct but tactful, and focus on facts not feelings.

Don't be a "flip-flopper." While some politicians seem willing to say anything they think voters want to hear, in the workplace, inconsistencies don't go unnoticed. Character, credibility and steadiness still matter, especially when firms are considering who should represent them in high-profile positions. Play by the rules. Seemingly minor slipups, such as choosing to ignore office protocol or working behind a colleague's back, can have major implications. If you make a misstep, make amends quickly. Playing by the rules still counts for something in any political arena.

Connect with constituencies. While you don't want to blurt out whatever it takes to appeal to a specific group, savvy candidates do tailor their message to their audience. Apply the same tactic to your colleagues; observe their unique work styles, priorities and communication preferences, and be willing to adapt your approach.

Dodge controversy. Whether someone tries to elicit your opinion on a new leader within your organization, proceed with caution. Better yet, bow out completely or say something that signals you're remaining neutral. Getting into heated debates at work -- about internal or external or politics -- can leave lingering ill will and could permanently damage your reputation for diplomacy.

Despite your best efforts to navigate office politics, missteps are likely to occur. Even the most polished politicians make the occasional gaffe. To remain above the fray and keep your career moving forward, be attuned to political undercurrents in your organization, but don't allow yourself to get pulled into situations that could compromise your working relationships or reputation.
