Nautica Charity Poker Tournament

Rules of Participation

January, 2011

Participation

1. Only persons who are at least 21 years of age may participate in a Team Cleveland poker tournament ("Tournament") at the Nautica Charity Poker Festivals. 2. Buy-In Amounts, prizes, entry fee, dates and deadlines for registration may vary from Tournament to Tournament. All Players agree to abide by the rules and regulations outlined on the registration and/or receipt form for each individual Tournament.

Recording

1. All Players acknowledge and consent that Team Cleveland Tournament events may (but are not required) to be recorded for subsequent broadcast on television and/or by any and all other means without limitation ("Broadcast"). 2. All Players acknowledge and consent that his/her name and/or likeness at such Tournament may be used in all forms of recording ("Recordings") for later Broadcast; provided, however, there is no guarantee, express or implied, that his/her name and/or likeness will actually be used as part of a later Broadcast, or that the recording of the Tournament will ever be Broadcast. 3. All Players acknowledge that he/she will not be compensated, directly or indirectly, for the use of his/her name and/or likeness in any such Broadcast. 4. If recorded, all Players agrees to permit the display of his/her hole cards to the pocket cameras, for each and every hand, at the final table during the Tournament. 5. All Players will be required to show an Ohio Driver's License, State I.D., Passport or Military I.D. to verify identification. 6. All Players agree that he/she is not permitted to wear at the final table during the Tournament poker, casino, and/or gaming and gambling ("Activities") related clothing of any kind, including hats and other headgear, which bears the name, logo and/or other words or symbols in any form related to such Activities. 7. All Players release the Nautica Charity Poker Festivals, Inc., Jacobs Investments Management Co., Inc ("JIMCO"), and its affiliates, Jacobs Entertainment, Inc., Cuyahoga County, all participating charities in the Team Cleveland events and the Nautica Charity Poker Festivals and promoter and/or broadcaster of such Recordings from and against any and all claims by third parties arising out of his/her participation in such Tournament and/or the use of his/ her likeness in any subsequent Broadcast, and waives his/her rights in that regard. Furthermore, he/she gives to the foregoing the unrestricted right and permission to copyright and use and re-use, and publish and re-publish, his/her name and/or likeness and relinquishes any and all right to examine and approve the foregoing Recordings and Broadcasts.

World Series of Poker®

1. All Players acknowledge that Team Cleveland events may, from time to time, involve the potential to win funds for seats at the World Series of Poker. In such an event, all players agree as follows: A. Registration and accompanying seat in the World Series are non-transferable. B. The winners of such events ("Winner") shall be entitled to certain cash prizes ("Winnings") announced as part of each event. In the event that the actual Registration Fee and/or expenses to participate in the World Series of Poker are more than such Winnings, the Winner shall be responsible for the excess. C. Each Winner shall be responsible for paying federal, state and local income and/or other taxes on Winnings. Each winner should consult his/her tax advisor for further information. D. Each Winner agrees to abide by all the rules and regulations of the WSOP ® and the Nautica Charity Poker Festivals ®. E. It is the responsibility of each Winner to insure that he/she is registered for the Main Event®. 2. Each Winner agrees to defend and indemnify the Nautica Charity Poker Festivals, Inc., Jacobs Investments Management Co., Inc, and its affiliates, Jacobs Entertainment, Inc., Cuyahoga County, the Participating Charities, the WSOP ®, from and against any and all suits, causes of action, claims, damages and expenses of every kind and description, including those that are direct and indirect and consequential and inconsequential, including claims by third parties, arising out of his/her participation in (including traveling to and from) both the Tournament and the Main Event®.
