Permit Descriptions

CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related facilities in the coastal area as defined by the Act. Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require certification by the DEP prior to the issuance of the permit by the federal agency. Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated transition areas. A Flood Hazard Area Permit, an U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may also be required. General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously contaminated with petroleum products. NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwater, a discharge from an indirect user or the land application of municipal and/or industrial residuals. (A more comprehensive definition of activities, which require a permit, may be found at N.J.A.C. 7:14A-2.4) Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq. Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands. Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal systems. Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable waterway in the State. Coastal Wetlands: A permit authorizing disturbances to Mapped Tidal Wetlands under the Wetlands Act of 1970, N.J.S.A. 13:9A"

General Information

The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Flood Hazard Area (FHA) permits, Tidal Wetlands permits, Waterfront Development permits and Treatment Works Approvals (TWA). In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however, constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover. Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public. Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal. Interest in these hearings is generally limited to those directly involved. DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

NOTICE OF PUBLIC COMMENT PERIOD REGARDING A SOLID WASTE FACILITY PERMIT FOR A SW Transfer Station Permit The New Jersey Department of Environmental Protection, Solid & Hazardous Waste Management Program, hereby gives notice that it has tentatively approved a Solid Waste Facility Permit modification application regarding the operation of the existing SW Transfer Station Permit for ADVANCED ENTERPRISES RECYCLING TS/MRF d/b/a DOREMUS AVENUE RECYCLING AND TRANSFER, LLC (DART). The application for a Solid Waste Facility Permit modification was submitted in accordance with the requirements established at N.J.A.C. 7:26-2. The facility is currently permitted to accept waste types ID10 (Municipal), ID13 (Bulky waste), ID13C (Construction and demolition waste), ID23 (Vegetative waste), and ID27 (Dry industrial waste) and with an approved maximum capacity of 2,000 tons per day. DART is requesting to implement the weekly average concept at the facility to accept and process up to 2,650 tons on any given day, not to exceed 14,000 tons per week (2,000 tons X 7 days per week = 14,000 tons/week). The public comment period on the draft permit action begins on the date of the publication of this notice and will close in thirty (30) days. NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF INTENT TO SETTLE Flood Hazard Area Permit TAKE NOTICE THAT THE DEPARTMENT OF ENVIRONMENTAL PROTECTION (Department) intends to settle a matter to allow for the placement of 180 linear feet of stormwater pipe within and alongside Stephensburg Road, within the riparian zone of Stephensburg Brook. The stormwater pipe is associated with a proposed single-family house. The application was received by the Department on June 28, 2007 which is prior to the November 5, 2007 effective date of the current Flood Hazard Area Control Act (FHACA) Rules, N.J.A.C. 7:13-1.1, et seq. The prior FHACA Rules require a 50-foot riparian zone adjacent to Stephensburg Brook. The applicant has minimized the riparian zone disturbances to the maximum extent possible and the project meets the prior Rules. In addition, the applicant has addressed the reason for the Department's prior denial of the application by providing a Highlands Applicability Determination and Water Quality Management Plan Consistency Determination letter which finds the project to be exempt from the requirements of the Highlands Water Protection and Planning Act, N.J.S.A. 13:20-1, et seq., and the Highlands Water Protection and Planning Act Rules, N.J.A.C. 7:38-1.1, et seq., and consistent with the Water Quality Management Plan. The Department, therefore, intends to issue a Flood Hazard Area Permit in accordance with the prior FHACA Rules. This is a renewal permit action for Warren Residential Group Center. The facility is a state owned correctional center under the jurisdiction of the Juvenile Justice Commission. The facility is located on a 69.82 acre parcel and consists of an administrative building, a farmhouse and a classroom. The facility houses up to 40 juvenile clients and a 20 person staff. The existing wastewater disposal system consists of three (3), 3,000 gallon septic tanks in series, a 2,600 gallon dosing tank, and four (4) 4,060 sq. ft. subsurface disposal beds. The on-site disposal system is designed to handle a maximum daily design flow of 7,500 gpd. Ground Water Quality Standards are met at hydraulically down gradient monitoring wells. This NJPDES-DGW renewal permit action will authorize a discharge to two proposed disposal beds from a proposed expansion to the Upper Walkill Wastewater Treatment Plant. The new discharge will consist of treated wastewater from two areas of the Vernon Town Center. The first area is at Route 94 and Route 515 consisting of a mix of existing commercial and residential units. The second area is the Mountain Creek Development and consists of the Black Creek Sanctuary Condominium Complex and the Mountain Creek Village, which will consist of new hotels, retail commercial units, condominiums and a conference center. The proposed discharge of 265,000 gpd of sanitary wastewater will originate from two areas of the Vernon Town Center. The wastewater will be directed to the Upper Wallkill Wastewater Treatment Plant located in Hardyston Township. Wastewater disposal will be facilitated through two subsurface disposal beds with a total area of 81,154 sq. ft. The wastewater treatment facility will be designed to meet the Ground Water Quality Standards (GWQS) for all parameters of concern, except fecal coliform bacteria, prior to discharge to the disposal areas. Although disinfection will be provided, the ground water quality standard for fecal coliform bacteria will be achieved by utilizing the unsaturated native soils beneath the disposal area. All residuals generated under this NJPDES Discharge to Groundwater (DGW) permit will be wasted to the Upper Wallkill Wastewater Treatment Plant's existing sludge thickener and will be monitored under NJPDES Discharge to Surface Water (DSW) permit NJ0053350. All residuals generated at the Upper Wallkill Wastewater Treatment Plant are composted under NJPDES permit NJ0109525. Two Bridges Sewerage Authority (TBSA) operates a regional wastewater treatment facility located in Lincoln Park, Morris County. TBSA processes sewage sludge generated at the facility, as well as a sludge from outside sources, by incineration. Surface water discharge is permitted through NJ0029386.The residue resulting from incineration is pumped as slurry to two unlined lagoons. Water from the slurry is reduced by evaporation and infiltration and the ash is removed offsite. Three monitoring wells monitor impact of the lagoons on ground water quality.

This a renewal permit action. The permittee currently operates at a permitted flow of 2.25 MGD. The permittee currently discharges the treated sanitary effluent to the ground waters of the State via eighteen (18) existing off-site infiltration/ percolation (I/P) lagoons which are located approximately 3.8 miles northwest of the plant on Erial-Williamstown Road. Three of eight on-site lagoons have plastic membrane liners which have been installed. The remaining five on-site lagoons continue to be used until implementation of the long-term wastewater management plan. The lined lagoons (surface impoundments) provide 3.5 million gallons of storage for flow equalization to the off-site basins. Sludge generated by Winslow Township Wastewater treatment Plant is managed at the Camden County Municipal Utilities Authority located in Camden, New Jersey. Only seventeen (17) of the eighteen (18) off-site lagoons will be in service at any one time, leaving an extra basin to allow for service without interrupting the operating sequence. Each basin will be filled on day one and day four of a fourteen day cycle or on day one of a seven day cycle. The Department has added two new residual monitored locations, SLB3 (SQAR Sludge Storage Tank) and SLP3 (SQAR - Sludge Production). Monitored location SLB3 was added to accommodate reporting of liquid residuals removed from the sludge storage tanks, and SLP3 was added to accommodate reporting of the annual residual production Waste Characterization Report (WCR). The Department is granting a reduction in the number of parameters that must be reported on the annual residuals "production" WCR at monitoring location SLP3, pursuant to N.J.A.C. 7:14C-1.13(c). Monitored location SL3A (Belt Filter Press) will be deactivated when the permit becomes effective since the belt filter press has recently been shut down. All SQAR reporting information for the liquid residual currently being removed shall be reported under monitored location SL3A until this permit becomes effective. In the event the belt filter press is turned back on the permittee shall notify the Department in writing so that monitored location SL3A can be reactivated and the appropriate forms under SLB3 deactivated as detailed under Part III of the permit. In addition, the Department has also deleted 2,3,7,8-Tetrachloro-dibenzo-p-dioxin (TCDD) from the annual residuals "priority pollutant" WCR consistent with changes made in the Sludge Quality Assurance Regulations on June 5, 2006. This is a renewal permit action for Neshanic Valley Golf Course. The facility is a 27 hole golf course with a 9 hole par 3 course. The facility also includes a 3,000 ft2 indoor meeting room (2nd floor Clubhouse), a clubhouse with pro shop and snack bar, a maintenance building and a learning center. Sanitary wastewater generated by the facility is managed by three on-site septic systems and four disposal beds. Separate disposal systems serve the clubhouse, the maintenance building and learning center Sanitary waste generated by the facility is managed by three separate on-site septic systems, and the wastewater is discharged to the ground waters of the State via four, on-site subsurface disposal systems. The disposal system serving the clubhouse, which has been designated as discharge sampling point T01T, consists of two (2) 42' x 94' disposal fields. The learning center and the maintenance building systems consist of one (1) 21' x 42' disposal field, and a separate 18' x 36' disposal field. Flow from the systems shall be limited as follows: clubhouse, 4,900 gpd, learning center 560 gpd, and the maintenance building 450 gpd.
