ENVIRONMENTAL PLANNING & ASSESSMENT ACT 1979 MODIFICATION (MOD 91-7-2005) OF DEVELOPMENT CONSENT (DA 200-82004) ERECTION OF OFFICE/WAREHOUSE BUILDING ON PART LOT 306 DP 1035614, LOT 206 DP 1030744 AND LOT 4081 DP 1064965 BUTU WARGUN DRIVE, GREYSTANES PURSUANT TO SECTION 80 OF THE ENVIRONMENTAL PLANNING AND ASSESSMENT ACT 1979 (FILE NO. 9039574)

I, the Minister for Planning, pursuant to Section 96(2) of the Environmental Planning & Assessment Act, 1979 (prior to 1 August 2005), modify the development consent referred to in the attached Schedule 1 subject to conditions in the manner set out in the attached Schedule 2. The reasons for the imposition of conditions are: (1) (2) (3) to amend the approved set of plans relating to the development; to amend the on-site car parking limit; and to ensure site landscaping achieves the recreation of a Cumberland Plain Woodland community and consists of locally available species.

The applicant is solely responsible for ensuring that all additional consents and agreements are obtained from other authorities, as relevant.

Appeals

The applicant has the right to appeal to the Land and Environment Court under Section 97 of the Environmental Planning and Assessment Act, 1979. The right to appeal is only available within 3 months after the date on which the applicant received this notice.

Appeals--Third Party

A third party right to appeal to this development consent is available under Section 123, subject to Section 101, of the Environmental Planning and Assessment Act, 1979.

Any advice or notice to the consent authority shall be served on the Director-General.

PART C--DEFINITIONS

The definitions within this modification are consistent with the definitions in Schedule 1 of the consent to development application 200-8-2004.

A maximum of 114 113 on-site car parking spaces are approved, which includes courier bays and disabled parking spaces. (c) A new condition B33(a) is to be inserted after condition B33, as follows:

Landscaping subject to MOD 91-7-2005

All landscaping shall be planted in accordance with landscape drawings 4042-01 Revision D and 4042-02 Revision D. Landscaping details shown on the architectural drawings JD-GSDA-001 Revision C, JD-GS-DA-002 Revision C and JD-GS-DA-200 Revision C are not approved. All species to be planted shall comply with conditions B32 and B33 of DA 200-8-2004.
