EXECUTIVE SUMMARY

In accordance with clause III.A.1(a) of Schedule 2 of the AIPRD-L002 loan agreement for Eastern Indonesia National Road Improvement Project (EINRIP), this report is the monthly Project Progress Report (PPR) for the month of September 2009. Preparation of Projects Design for all packages has been legalized by BinTek and legalization of integration of environmental and social considerations is complete. Environmental and Social Studies Environmental studies (AMDAL or UKL/UPL) for 19 projects were either not required or have been completed. AMDAL process for ESS-04, ESS-05, ESS-6 (South Sulawesi) and EKS-05, EKS-06 (South Kalimantan) is ongoing. There was no land acquisition for 2 packages (EBL-01. EBL-02). Land acquisition process for 5 packages (ESU-01, ENB-01AB, ESR-01, EKB-01 and ESS-02) has been completed. Of the remaining 17 projects, LARAP process is underway and will be clarified when APBN and APBD budget allocation for 2010 is confirmed. Procurement of Civil Works 5 Contracts awarded to date (EBL-01, ENB-01AB, ESR-01, EKB-01, ESS-02). Bid evaluation report for 2 packages (ESS-01, ESR-02) awaiting NOL from AusAID. Bid evaluation under review for 5 packages (ENB-01C, ENB-02, ENB-03, ESU-01, EBL-02). Bid process on-going for 2 packages (ESS-03, ESH-01). Retendering proposed for EKS-01. Procurement yet to commence for remaining 9 projects. EINRIP Project

The Australian Indonesia Partnership for Reconstruction and Development (AIPRD) is administered by the Australian Agency for International Development (AusAID) in partnership with the Government of Indonesia (GOI). As part of AIPRD, both governments have committed loan funds (A$300 million) to the Eastern Indonesia National Road Improvement Project (EINRIP). EINRIP supports a program of National Road and bridge improvement projects, with major focus on roads upgraded to National roads from previously Provincial or non-status roads and limited road capacity expansions. Approximately 4,300 km of roads are affected, of which around 500 kilometers and 14 steel truss bridges are covered by this project (packages ESU-01, ESH-01 and SER-02). 1.1 Project Objectives

The project development objective is "To support regional economic and social development in Eastern Indonesia by improving the condition of the national road network." The main objective is to improve road links to an acceptable standard, suitable to their new status, to help ensure that the National road network provides acceptable standards of service and accessibility, and is capable of supporting local and regional economic development. 1.2 Project General Data a. Project Scope Betterment treatments including minor widening on inter-urban roads; Replacement or improvement of bridge and other structures that lie within the selected road sections; A limited road expansion project (capex); and A steel truss bridge replacement/rehabilitation program for existing deteriorated bridges throughout Indonesia.

Civil Works - Status of Environmental Studies

The ESS studies are discussed in the two broad categories of studies; environmental studies and land acquisition process. 1. EBL- 01 Tohpati ­ Kusamba, Bali UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. There was no land required for this package. 2. EBL- 02 Tohpati ­ Kusamba Section , Bali No AMDAL (or UKL/UPL) study required for this package. There was no land required for this project. 3. ESH- 01 Lakuan ­ Buol , Central Sulawesi UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. For LARAP completion additional data are needed on the size of the affected buildings. Data have been requested from PU Kabupaten. Upon receipt of data, the LARAP can be completed within one week. EINRIP PMU to remind PU Kabupaten to provide the additional data for LARAP completion. 4. ESU- 01 Molibagu ­ Mamalia ­ Taludaa , North Sulawesi UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. Land acquisition process is complete. LARAP monitoring report completed and submitted. 5. ENB- 01AB Sumbawa Besar Bypass , NTB (Sumbawa) UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. Land acquisition process is complete. LARAP monitoring report completed and submitted. 6. ENB- 01C Pal IV ­ Km 70, NTB (Sumbawa) UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. There are 749 peoples affected by project. LARAP study and Pleno meeting and payment process was finished. Plan for contract award is in October. However, the comparison of compensation payment evidence to PAP with the LARAP's list of approved PAP shows discrepancies in the names/numbers of paid PAP versus those listed in the LARAP. This will be reflected in a Draft Land acquisition monitoring report, to be submitted in mid October 2009. A field verification process will be required to determine if all identified PAP listed in the LARAP have received fair and proper compensation. 7. ENB- 02 Km 70- Bts. Cabdin Dompu , NTB (Sumbawa) UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. LARAP and Pleno meeting has finished and it is processing of payment compensation now. Land acquisition monitoring report will be submitted in November 2009, once PMU/PMSC receives payment evidence. 8. ENB- 03 Bts. Cabdin Dompu ­ Banggo , NTB (Sumbawa) UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. LARAP and Pleno meeting is finished. Data for payment evidence has been sent to PMSC and Land acquisition monitoring report will be submitted in November 2009. Plan for contract award is in October. A Draft Land acquisition monitoring report was submitted in October 2009. However, the comparison of compensation payment evidence to PAP with the LARAP's list of approved PAP shows discrepancies in the names/numbers of paid PAP versus those listed in the LARAP. A field verification process will be required to determine if all identified PAP listed in the LARAP have received fair and proper compensation. 9. ENT- 01 Ende ­ Aegela , NTT UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. LARAP and pleno meeting was finished. Socialization and negotiation process under review. Subject to revised APBD 2009, land payments can be processed. 10. ESR- 01 Tinanggea ­ Kasipute, South East Sulawesi UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. Land acquisition process is complete. LARAP monitoring report completed and submitted. 11. ESR- 02 Kasipute ­ Bambaea, South East Sulawesi UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. LARAP and Pleno meeting was finished and it is processing of payment compensation now. Plan for contract award is in October 2009, which may not be possible due to availability of Land acquisition monitoring report expected to be completed in Nov/Dec 2009. 12. ESS- 01 Sengkang ­ Impaimpa ­ Tarumpakke , South Sulawesi No AMDAL (or UKL/UPL) study required for this package. LARAP and Pleno meeting is finished. Payment process has finished. Plan for contract award is in October. However, the comparison of compensation payment evidence to PAP with the LARAP's list of approved PAP shows discrepancies in the names/numbers of paid PAP versus those listed in the LARAP. This will be reflected in a Draft Land acquisition monitoring report, to be submitted in mid October 2009. ESS- 02 Bantaeng ­ Bulukumba , South Sulawesi No AMDAL (or UKL/UPL) study required for this package. Land acquisition process is complete. LARAP monitoring report completed and submitted. 14. ESS- 03 Jeneponto ­ Bantaeng , South Sulawesi UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. There are 1187 people affected by project. LARAP and pleno meeting was finished. LG is in process of compensation payment. Plan of bidding process is October 2009. 15. ESS- 04; ESS-05 & ESS-06 Bulukumba ­ Todong ­ Sinjai, South Sulawesi There is one AMDAL for three packages. Terms of Reference (KA ANDAL) of AMDAL has been revised by consultant and is informally cleared by BLHD/Bapedalda. Submission of Final KA ANDAL in October 2009. LARAP is complete but there is no pleno meeting yet. Plan of bidding process is on early 2010. The LG Kab Bulukumba has decided to provide financial compensation to PAP for loss of buildings but will offer no land compensation but instead will pay for the replacement of old and construction works for new property fences towards the road. The LG Kab Sinjai has provided a budget for land acquisition. However, the budget falls short of the estimated LA costs. Additional budgets from the LG Kab Sinjai will be allocated with APBD 2010. 16. EKB- 01 Pontianak ­ Tayan , West Kalimantan No AMDAL (or UKL/UPL) study required for this package. Land acquisition process is complete. LARAP monitoring report completed and submitted.

17. EKS- 01 Martapura ­ Ds. Tungkap , South Kalimantan No AMDAL (or UKL/UPL) study required for this package. There are 54 peoples affected by project. LARAP study and Pleno meeting was finished and 52 of PAP have been paid by revised APBD 2008. 2 PAP have not been paid yet (negotiation is still in process). With the re-tender requirement for this project, the process will be set back approximately another 6 months, which will allow the negotiation with the two remaining PAP to be completed and compensation to be disbursed. 18. EKS- 02 Banjarmasin ­ Bts. Kalteng, South Kalimantan No AMDAL (or UKL/UPL) study required for this package. There are 775 peoples affected by project. LARAP and Pre Pleno meeting is finished. There are semipermanent structures made from wood within the ROW. Land acquisition within the ROW has been done in 1995. Since then land has been occupied within the ROW and is being used for small-scale commercial activities with ~80% new PAP as per recent LARAP. LG Kabupaten Barito Kuala has conducted socialization to the people whose land and structure will be affected by the project. Clearing of ROW will be conducted next. PMSC and PMU will conduct a site visit to confirm site conditions and assess the process upon request by LG/Balai. In addition to the existing ROW, the road design requires 5,031 m2 additional land. Two solutions are proposed, one relates to design modifications to construct a retaining wall; second is to request additional funding for land acquisition of 5,031 m2. 19. EKS- 03 Jl. A.Yani (Martapura ­ Ds. Tungkap) , South Kalimantan UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. LARAP and pre-pleno meeting has been finished. There is no process of compensation payment. Plan of bidding process is in July 2010 but there is no budget for land acquisition. 20. EKS- 04 Ds.Tungkap ­ Rantau , South Kalimantan UKL/UPL was required, has been completed and approved by DGH and BLHD/Bapedalda. LARAP and pre-pleno meeting has been finished. There is no process of compensation payment. Plan of bidding process is in July 2010 but there is no budget for land acquisition. 21. EKS- 05 & EKS-06 Barabai ­ Mantimin ­ Dahai, South Kalimantan There is one AMDAL for two packages. Terms of Reference (KA ANDAL) of AMDAL has been revised by consultant. There are 4584 peoples affected by project and LARAP and Pre Pleno meeting was finished. Process of compensation payment is not yet available. Plan of contract process is on October 2009. There is no budget for land compensation. Discussion of Terms of Reference is waiting for budget availability. Table 1 presents the status of environmental studies and land acquisition process.

Civil Works - Procurement Status

During September 2009, following key procurement activities occurred: Procurement of EKS-01 The first version of Bid Evaluation Report (BER) for EKS-01 was forwarded to AusAID on 15-May-09, who did not agree with the disqualification of 5 bidders and suggested PAS and PC to seek clarifications from bidders. After a series of meetings in July 2009, PAS sought clarifications from the 5 bidders, and after evaluation of the responses by PAS and PC, presented the re-evaluation result (not the BER) on 30-Jul-09. The re-evaluation was discussed in the 28-Aug-09 meeting between PAS, PMU, AusAID and PPK, and AusAID issued a letter on 03-Sep-09, suggesting that due to non-acceptable bid validity process and disagreement with re-evaluation of clarifications, the package should be re-bid. The issue still remains unresolved. Procurement of ESU-01 The BER for this package was submitted to AusAID on 29-Jul-09 and discussed in 28-Aug-09 meeting, AusAID in their letter of 8-Sep-09, did not agree with the recommendation of single qualified bidder out of the seven bidders. They have asserted that at least two bidders could not provide clear evidence of equipment capability, but this did not form a material non-compliance. They have suggested that both bidders should be considered to be compliant in equipment criteria and that final BER should give equal score to both bidders. The Director of Planning (DGH) has written to Director of Roads and Bridges (Eastern Region) on 28-Sep09 to consider revision of the BER in light of AusAID comments. This is yet to be resolved as PAS and PC are to work together in bid re-evaluation. Procurement of ESS-01 ESU-01: PAS and PC have different evaluation of the second lowest bidder, although both agree on the lowest winning bid. The BER has been forwarded to AuSAID for NOL for award. Procurement of ESH-01 NOL for procurement was issued by AusAID on 11-Sep-09. Bid documents was finalised during September including comments from AusAID. Bid opening will be advertised in October 2009. Procurement of ESS-03 The original bid opening is planned for 6-Oct-09. The draft addendum to bidding documents is under p[reparation by PC in consultation with PAS and once finalised will be sent to AusAID for NBOL. There is possibility that bid opening will be extended. Other activities Bid Evaluation under review for EBL-02 (bid opened on 26-Aug-09), ENB-01C (bid opened on 4-Aug-09), ENB-02 (bid opened on 4-Aug-09), ENB-03 (bid opened on 25-Aug-09) BER for ESR-02 sent to AusAID for NOL on 28-Sep-09.

Procurement Plan & Implementation Schedule

The Project Procurement Plan is the key document that sets out the planned procurement activities for various sub-projects. This Plan is required to be updated every quarter, submitted to AusAID for no-objection and once NOL from AusAID is received, is to be uploaded on the EINRIP web site. Subsequent to the review by AusAID, NOL for Procurement Plan Version 4 (revised 4 June 2009) was awarded on 10-Jun-09.

To appreciate the impact of the revised procurement plan, an Implementation Schedule has been drawn up that broadly displays the estimated duration of the contract and end of Defects Notification Period. The Procurement Plan (Ver 4, 26-May-09) and actual dates as on 30-Sep-09 are shown in Appendix 2. There is only one Goods Contract ESB-02 for Supply of Prefabricated Steel Bridges. As per Procurement Plan No. 3 (released on February 2009), the amount required to cover disbursements up to 30 September 2009 was estimated at A$ 41.86 million. But, actual payment for the same period is A$ 18.43 million, about 44% of the planned disbursements. The primary reasons for lower expenditure are delays in completion on environmental studies and reports: and delays during procurement process. This expenditure gap is expected to be considerably reduced once the 8-10 packages currently under procurement are awarded and commenced during 3rd and 4th Quarter 2009. The S-curve based on this plan is shown below.

10 Monthly Progress Review Meeting

The monthly progress review meeting was held on 16-Sep-09 in DGH and attended by PMU, EMU (AusAID), PMSC and PAS consultants. RSC consultants could not join the meeting, but participated through a phone hookup. The monthly progress review meetings were proposed in the 4th EINRIP Joint Management Meeting, and the 16-Sep meeting was the first meeting in this regard. The meeting discussed the progress of project preparation, procurement and implementation activities. Main issues discussed in 16-Sep meeting included: Review of outcome of ICR (Independent Completion Report of PPC Consultants) Possible changes to the loan agreement Procurement Seminar/Workshop was proposed by PAS Update progress on procurement activities Status of ongoing construction Pending Land Acquisition issues. Consultants' staffing, invoicing & reports Budget Allocations for 2010.

11 Performance Indicators of ACAP-EINRIP Implementation

During September, discussions were held between PMU, Inspectorate General of DPU and BPKP on development of performance indicators for evaluation of ACAP implementation. These indicators were initially broadly based on the seven key areas of ACAP including: Establishment of Project Website (Pengelolaan Website) Bidding Preparation (Persiapan Lelang) Bidding Evaluation (Evaluasi lelang). Contract Implementation (Pelaksanaan kontrak) Enhanced Complaints Handling Procedures (Penanganan Pengaduan) Financial (Finansial) Audits (Audit) Each of the above was further classified into sub-indicators to completely encompass the key considerations of ACAP. The draft indicators are now under review by the BPKP and will be finalised in early October 2009.

12 HIV/AIDS Program for EINRIP

AusAID has had a number of discussions with PMU in relation to the appointment of a local NGO or similar organization to conduct training programs/awareness campaigns for the staff of contractors engaged on EINRIP packages. During September, potential providers of such campaigns were contacted and information was sought. PMSC will develop a proposal to engage a suitable organisation for the training programs and /awareness campaigns. Modalities for procurement and appointment will also be developed and discussed with PMU and EMU. Arrangements are being made for a meeting with the AusAID HIV Adviser in early October to discuss this issue and request advice and information.

Soft and hard copies of Draft Instruction Manuals were checked and some revisions have been requested.
