PURPOSE: The purpose of this notice is to inform vessel owners, operators and managers of the Republic of the Marshall Islands (RMI) policy concerning the approval of Shipboard Oil Pollution Emergency Plans. This Notice supersedes Rev. 7/11 and reflects the addition of Indian Register of Shipping to section 5.0. APPLICABILITY: This instruction applies to the following RMI flag vessels: oil tankers over 150 gross tons (GT), and every ship, including yachts and fishing vessels, other than an oil tanker over 400 GT.

REQUIREMENTS: 1.0 RMI is party to the International Convention for the Prevention of Pollution from Ships 1973, as modified by the Protocol of 1978, generally known as MARPOL 73/78. All nations that are parties to MARPOL 73/78 are required to take the necessary steps to ensure that each of their vessels has on board a SOPEP prepared in accordance with Regulation 37 of Annex I of MARPOL 73/78, reference (a) above, and the International Maritime Organization (IMO) Guidelines contained in Reference (c) above or reference (d) above. Every ship of 150 GTs and above certified to carry noxious liquid substances in bulk shall carry on board a shipboard marine pollution emergency plan for noxious liquid substances 1 of 2

prepared in accordance with Regulation 17 in Annex II of MARPOL 73/78, reference (b) above, and the IMO Guidelines contained in reference (d) above.


In the case of ships to which both Regulation 37 of Annex I and Regulation 17 of Annex II of the Convention also apply, the two (2) plans may be combined. In this case, the title of such a plan shall be Shipboard Marine Pollution Emergency Plan (SMPEP), and it should be prepared in accordance with the IMO Guidelines contained in reference (d) above. Owners and operators of vessels intending to trade in the United States (U.S.) should note that all tank and nontank vessels are required to have a U.S. Coast Guard approved Vessel Response Plan (VRP) or Nontank Vessel Response Plan (NTVRP) on board in addition to the SOPEP(s) required by MARPOL 73/78, references (e) and (f). These rules also apply to both delivering and receiving vessels conducting bulk oil cargo lightering operations within the exclusive economic zone of the U.S. (where cargo is destined for a port or place in the U.S.). Vessels that do not have such a VRP or NTVRP may be subject to U.S. Coast Guard enforcement action and may not be permitted to enter U.S. waters.


PLAN DEVELOPMENT AND APPROVAL: 5.0 Because each Classification Society/Recognized Organization (RO) has different procedures, vessel owner, operators and managers should contact the respective Classification Society for guidance on the development and approval of these plans. The RMI Maritime Administrator (the "Administrator") has authorized the following Classification Societies to approve these plans on its behalf: 6.0 American Bureau of Shipping Bureau Veritas China Classification Society Det Norske Veritas Germanischer Lloyd Indian Register of Shipping Korean Register Lloyd's Register Nippon Kaiji Kyokai Polski Rejestr Statków Registro Italiano Navale Russian Maritime Register of Shipping

The Administrator has also authorized the following Appointed Representatives (ARs) to approve these plans for Yachts: Hellenic Register of Shipping International Yacht Bureau Regs4ships Ltd


The RO or AR you select for your plan development will be familiar with the U.S. regulations (NVIC 01-05 and CH-1) and should be able to assist you in the process of developing VRPs and NTVRPs and obtaining U.S. Coast Guard approval. 2 of 2
