Are you using a "GRANDFATHER RIGHTS" CPC ?

New regulations will come into force on 3 December 2011 which will remove the existing Grandfather rights exemption from the requirement to hold a CPC qualification gained via examination. "Grandfather Rights" Transport Managers who wish to continue in their current role will be contacted by the Traffic Commissioner in the next few weeks to claim an extended exemption. BUT under the new rules extended Grandfather Rights can only be claimed by those who can provide proof that: They have been listed as a transport manager on the same O Licence continuously for the period of 10 years before 4 December 2009. (4 December 1999 to 4 December 2009) OR They can provide signed declarations from previous operators that they have worked for (and been listed on the O Licence) as a Transport Manager, covering the required ten-year period. Under the new rules existing operators using Transport Managers who cannot establish professional competence under the `10 year rule' will, subject to the discretion of the Traffic Commissioner, be given up to 6 months to employ a properly qualified Transport Manager. Any Grandfather rights CPC holders who left the industry since 4 December 2009 will have until 4 December 2013 to apply for the extended exemption. No applications will be processed after 4 December 2013. Affected operators MUST either apply for an extended Grandfather Rights exemption or make arrangements to employ an examination gained CPC holder.
