TERMS AND CONDITIONS

1. Please have your driver's license ready to present when registering for a number. 2. All out-of-state buyers paying by check must have a current letter of credit on file to receive a bidding number. 3. A purchase invoice will be filled out for each horse purchased by a buyer. Name and address is to be filled out exactly how the purchaser wants a horse registered. We will not be responsible for errors on transfer if purchase invoice is not properly and clearly filled out. 4. All horses listed in this catalogue are guaranteed sound by their owner. The guarantee is strictly by the owner and not the sale management. Right of recourse must be directly to the owner and not through South Dakota Horse Sale, owners, auctioneers or managers. We act only as agents for consignors in the sale. 5. Be sure to inspect any horse of interest to your satisfaction BEFORE you buy. A veterinarian is available prior to sale time to answer any questions. When horse leaves the ring all sales are final. 6. We DO NOT charge sales tax on horse purchases in South Dakota. This can be quite a savings to you on a several horse purchase. 7. A new halter will be provided with your horse purchase. All ride and lead in horses are haltered and tied after they are sold and leave the ring. A $2.50 fee for the halter will be assessed the buyer with seller paying an additional $2.50. 8. Phone or mail in bids are welcome. Buyers need to make arrangements by the Friday before the sale for credit references.

10. All Registration papers on Catalogued Paint & Quarter Horses will be mailed directly to the Associations for Express Overnite Transfer of Ownership. Reg. Papers should be received by you direct from AQHA office within 7-10 days after the sale. 11. Longtime, regular monthly buyers, easily recognized by our staff, may apply for a permanent V.I.P. buyer number. 12. We DO NOT allow private horse trading in the yards, alleys or on the premises before, during or after the sale. Any offender to this policy will be banned from the premises. All persons selling no-saled horses on the premises after they leave the ring must pay full commission in the office. 13. For convenience in the quick location of a certain horse, horses will be penned in numerical order throughout the yard beginning with Lot 1 nearest the check-in gate.

To Clarify the Soundness Guarantee Guarantee is strictly by the owner of the horse NOT BY SOUTH DAKOTA HORSE SALE, its owners or managers.

We have very qualified veterinarians on the grounds on sale day to offer their opinion on soundness. Keep in mind, it is rare that a catalogued horse sold at our sale will have a soundness problem but it has happened. The owner usually is not aware of it. That is why it is important that you look the horse over before you buy, not after. When the horse leaves the sale ring, the sale is final on our part. Anything different will be between the buyer and seller. Soundness to include sight out of both eyes, not to crib, hit the ground on all 4 & good in the air.

9. Writing an insufficient funds check the size of a horse purchase is a FELONY. Any person writing an insufficient funds check for a horse purchase will be turned over to the States Attorney for prosecution. Immediate legal action will be taken.

HORSE REPORT FOR MONDAY, NOVEMBER 16, 2009

SOLD 320 HEAD ­ Buyers & sellers registered in from Illinois, Colorado, Wisconsin, Kansas, Nebraska, Iowa, Minnesota, Wyoming, North Dakota and all across South Dakota. Lots of buyer interest in the award or money winning proven saddle horse, (supply & demand is the name of the game) but with the economy and recession going on right now, a lower cattle market, plus going into winter feed costs, buyers were pretty conservative with the amount they want to spend on that easier to find or a average looking & broke saddle horse. We are thinking after the 1st of the year, buyers will feel a little more confidence in the economy coming back and let loose on bidding prices. Now would be a good time to take advantage of the lower horse market and get into the buying end. The market could bounce back fast, and right now, one has a opportunity to make some good money. I would think, we are now bottomed out on horse prices. The horse industry seems to follow the stock market and cattle market and once those bounce back more, look for the horse market to come around just as fast. I expect we will be seeing a big shortage in the finished saddle horse before long. Check out our top sale horse pictures to see the conformation and proven record that brings in the top prices. Note, that one of the top sale horses was a non catalogued horse that sold at almost very end of the sale - proof, that a good broke horse with the correct conformation, good bone & muscle, will sell well anytime, early or late in the sale. Also note, that our 3rd top sale horse was a grade pony that sold for $2600. The pony had a proven horse show record and came with a lot of shape, disposition and conformation ­ & that is what makes the difference. Loose Horses ­ sold 128 Head. The big cleanup of over production from when the horse market was at its high peak 10-12 years ago is about over. We have been selling lots of stallions & broodmares these past several years as people got out of the business when the price of weanlings dropped drastically due to the over production that had been going on. Again, foreign slaughter horse plants taking big advantage of the fact all horse processing plants closed in the U.S., no alternative but to use them & show it by prices paid. PETA & HUS has hurt the economy a bunch. NOTE ­ our loose horse sale will now be starting later - at 10 AM instead of 9 AM. 7 % commission, $30 minimum. Sorry, we cannot accept crippled, blind and very thin horses, per USDA rules & regulations.

From Cleone ­ Did you folks read the following news article in the news awhile back? I found it quite interesting. ­ I am sure was illegal to sell the meat as one needs a tax liscense and meat & health inspector just as if it was beef, not just because its horse meat & unfortunately, the USDA will not inspect good old healthy, lean, low cholorestral horse meat. MIAMI ­Police have arrested two men, saying they sold horse meat at a Miami area ranch Roberto Aguedo Chavez, 53, the ranch owner andworker Ricardo Olivaez, 45, sold 10 pounds of meat to an undercover officer, police said. The price: $50. ($5 lb) Acting on a tip, police went to the ranch and bought meat from the men who stored it in an outdoor freezer. Chavez had several horses on the property and police think "he was killing his own horses and selling them for the profit", said Detective Edna Hernandez, a Miami-Dade police spokeswoman. The freezer was filled with suspected horse meat, Hernandez said. The men are charged for selling horse meat for human consumption. It is legal for a person to kill his or her own horse and eat the meat. It is illegal however, to sell the meat.

Thank You to everyone for supporting our Trailer Roping and the great distance many of you traveled. It was a very competitive roping with many close times & very good sportsmanship by the participants. The 2009 Titan 5th wheel 3-horse slant trailer was awarded to the roper receiving the most points thru out the days 5 team ropings. Points were awarded with first place team receiving 8 points, 2nd place 7 points, etc., down the line with 8th place receiving 1 point. Fast Time Teams received a bonus of 2 points. This was a very close race for the Trailer. Bret Knievel received 27 ½ points & $1337 in payback winnings & Jhett Williams, Faith, SD, 1st runnerup to our Trailer winner, had 26 points & won $1359, a mere $22 more payback cash than the trailer winner. Points made a difference. Close behind was Carson Musick with 23 points & Tyrell Moody with 22 ½ points.

Dear Cleone, I wanted to let you k now that a mare we bought from your sale 2 or 3 years ago was the one our daughter, Tanegal, won 4-H State Rodeo Reserve champ Jr. Girls Breakaway roping on. We have recently sold this mare and she is was headed to the Indian National Finals Rodeo. We likemares for Youth as they are loyal and safe for those kids. President Obama is trying to get the economy rolling again. I would think he would be rethinking his vote as a Illinois Senator in closing of the Illinois horse processing plant. The economy as well as the horses have suffered drastically due to the uneducated PETA & HUS organizations. I believe, their work in closing the US processing plants have not only hurt the economy, the horse industry & the horses themselves. Let the Agriculture people & their organizations, USDA Administration, etc, that understand livestock rule, & NOT some of these corrupt government Congressmen, who to me, seem to only vote for reelection votes, not common sense, and for the lobbyists who hand them big time money perks. I am sure many horse trailers are setting unsold, Saddle & Tack shops selling much less merchandise, horse farriers doing less shoeing, Vet supplies left unsold on shelves, less western boots, clothes, less horse movement means less at the Motels, gas station, restaurants, less at the Vets office, less at the building supply stores, less feed, and on and on. Than there is the Livestock commission firms like me, taking a bit hit. Than we don't want to forget, the unwanted horses themselves, left to endure a long miserable life of blindness, arthritis, tooth, lameness problems, many thousands left in enclosed dusty, hot, fly and manure infested government holding pens. What one of us humans would want that kind of life? And then there are those horses, that right now, are still able to be shipped out of the country to processing plants, but are not getting the strict humane handling that our US Plants were subject to. If we do not look forward to going to nursing homes, where there is plenty of nursing & doctor care, eye glasses, dental work, pain medicine, why would horses want to go to holding pens, where thousands stand and rarely able to see a Vet or assistant for pain medicine and worming and tooth work? And how about those animal activists putting up a fight to keep the 20,000 wild horses from being rounded up, after they were over grazing the land and going to starve eventually? They think there is not such a thing as overgrazing and that the helicopters may frighten them and they could also get a cut. How good a life is that! I have gotten scared many times over worse than that. I say "Government, feed the starving children in the underdeveloped countries with the unwanted horse and wild horse meat, rather than use our tax payer money on feed for those same horses. Well, it is good to know, our AQHA office is one segment that is working hard to get some facts and figures across to the government as to how the closing of the plants has hurt the economy and the horses. Keep writing & calling your Congressman. You can also write Barbara Linke c/o AQHA with any statistics and news from your local newspapers on abandoned or neglected horses. One baby step forward, is the news that the US Government Accountability Office has been instructed to come up with statistics as to how the closing of US plants has effected the horse industry, price wise as well as neglected and abandoned.

All out-of-state horses that are being rode or led in will need a health certificate dated 30 days or less. Horses sold as weigh-up horses during the loose horse sale DO NOT NEED HEALTH OR COGGINS TESTS. All out-of-state horses EXCEPT those from Nebraska, North Dakota and Montana need Coggins within the last 12 months if ridden or led in. Nebraska, N. Dak. & Montana horses Do Not require Negative Coggins tests to enter S. Dak. but need a health. Your copy of the health must be turned in at our office & will be retained for our attending Sale Day Veterinarians Records - as required by the State Sanitary Inspection Law. Should you purchase a horse & need a health to travel to another state, our attending Veterinarian, Dr. Jay Alberda, from Central Dakota Animal Clinic at Platte, SD can issue you one. If the state you're traveling to requires a negative coggins & the horse you purchased does not have one, Dr. Alberda has the equipment to test & can get you one in 2 hours or less. I have made the decision to slow down with some convincing from my family and doctor.
