THE GEORGIA STATE COSMETOLOGY BOARD Martha Harris ­ Chairperson Wednesday ­ March 3, 2004 9:00 a.m. Martha Harris called the meeting to order at 9:15 a.m. The minutes were reviewed and approved. The Executive Director presented a report. An Executive Session was conducted. Old Business was conducted. New Business was conducted. The meeting adjourned at 4:05 p.m.

A meeting of the Georgia State Cosmetology Board was held on Wednesday ­ March 3, 2004 at the Professional Licensing Boards Division office building. Those present were: From The Board Martha Harris, Chairperson Pauline Cornelius Gordon Barber Cynthia Stein Blanche Thrash From The Staff Eleanor Surrency, Executive Director Janet Jackson, Assistant Attorney General Linda Lofton, Inspector Angela Price, Board Secretary Martha Harris established a quorum and called the meeting to order at 9:10 a.m. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously to approve the minutes from the February 4, 2004 board meeting. Blanche Thrash moved, Pauline Cornelius seconded, and the board voted unanimously to enter Executive Session in accordance with O.C.G.A. 43-1-2(k) and 43-1-9(h) to deliberate on applications and enforcement matters and to receive information on applications and investigative reports. Voting in favor of the motion were Cynthia Stein, Gordon Barber, Pauline Cornelius, and Blanche Thrash. Appearing Before The Board AB&TW/apprenticehours appeared before the board for interview. MJH/reciprocityTX appeared before the board regarding her application. IF/reciprocityLithuania appeared before the board regarding her application. PBW/reciprocityGermany appeared before the board regarding her application. Enforcement Report Jacqueline Turner submitted case presentations. Legal Service Report Sally Hatcher submitted a request from the Attorney General's office that a list of salon citations be dismissed and reinspected. Ms. Hatcher submitted a summary of applicants with convictions.

Eleanor Surrency submitted a recommendation regarding the application of EDM/esthexam.

Ms. Surrency presented a request for copies of the file of BMF/mascos. Ms. Surrency presented a Petition For Variance or Waiver of rule 130-2-.03.from CBC/GL Ms. Surrencry reported that HB/Atlanta and TN&I/Atlanta salons were referred to Enforcement for operating unlicensed, however both salons are now in compliance. The Board concluded Executive Session in order to vote on these matters and to continue with public session. Executive Director's Report Eleanor Surrency's report included the following: 1. submitted a report of license Suspension/Denial/Suspension Release requests from GHEAC and DHR. 4. Reported that two schools were inspected since February 3, 2004. The board members requested that a review of the rules and regulations and the school inspection sheets is placed on the agenda for the April 2004 board meeting. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously to accept the signed Cease and Desist order for the following: Julus Hair Salon/Julus International Company, Elena Isaias, Yvette Hurd, Stephen Webster, Delores Platt, Haircastle Beauty Shop, Matia Kaba, Rougui Kara, Fatoumata M Camara, Mariame CamaraMariaama, Ndoumbe Sene, Ida Taal Njie, Yama African Hair Braiding, Odessa M Anthony, Salon Underwraps and to accept the report from Enforcement. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously to establish the following policy: When Enforcement finds that a Cosmetology license violation includes violations by a barber licensee, the information regarding the barber licensee is released to the Georgia State Barber Board.

Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously to establish a policy that persons who sign Cease and Desist Orders be re inspected within 45 days and if not in compliance be immediately referred by the inspector to the local authorities. Cynthia Stein moved, Pauline Cornelius seconded, and the board voted unanimously to accept the apprentice hours of AB&TW/apprenticehours and approve AB to sit for the examination. Pauline Cornelius moved, Gordon Barber seconded, and the board voted unanimously to approve the application of MJH/reciprocityTX. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously to deny the application of IF/reciprocityLithuania and invite her to sit for the examination. Pauline Cornelius moved, Blanche Thras seconded, and the board voted unanimously to deny the application of PBW/reciprocityGermany and invite her to sit for the examination. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously to establish the following policy: Reciprocity applicants will not be required to submit proof of substantially equivalent licensing requirements and mutual reciprocity from states/countries where proof of substantially equivalent licensing requirements and mutual reciprocity is on file in the administrative office of the Cosmetology Board. Pauline Cornelius moved, Cynthia Stein seconded, and the board voted unanimously to approve the application of ES/Ntexam attaching a Consent Order that license will be placed on probation until all court ordered fines and fees are paid in full. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously to approve the application of BY/cosreciprocityLA. Cynthia Stein moved, Pauline Cornelius seconded, and the board voted unanimously to approve the application of KH/cosexam attaching a Consent Order that the license be placed on probation until October 21, 2004.

Blanche Thrash moved, Pauline Cornelius seconded, and the board voted unanimously to approve the application of CS/cosexam attaching a Consent Order that the license will be placed on probation until March 7, 2005. Pauline Cornelius moved, Blanche Thrash seconded, and the board voted unanimously to dismiss the following cases and have an Inspector re- inspect the salon within 45 days. Salon Lic. # Cit. Pauline Cornelius moved, Gordon Barber seconded, and the board voted unanimously to deny the application of EDM/esthiticianexam and require that she complete the required number of months training. Pauline Cornelius moved, Blanche Thrash seconded, and the board voted unanimously to establish a policy that the board will not reciprocate school or apprentice hours of an applicant from another state/country to qualify for examination. Gordon barber moved, Pauline Cornelius seconded, and the board voted unanimously to deny the release of the file of BMFB/mascos. Janet Jackson submitted a memorandum of legal advise regarding extended classrooms for licensed schools of cosmetology under the Board's statues and rules. Gordon Barber moved, Cynthia Stein seconded, and the board voted unanimously to approve the Petition For Variance or Waiver of rule 130-2-.03 from CBC/GL subject to the following conditions: 1. The main campus shall be the physical location of the original license. (Application must be submitted for a duplicate license to post at the extended campus) 2. Both locations shall display current original school licenses. 3. The extended classroom shall not be more than five miles from the main campus. 4. The extended classroom shall be in the same county as the main campus. 5. No more than one extended classroom location is permitted per school license. 6. School and student's records shall be accessible at both locations in paper and/or electronic form. 7. An organizational chart showing the control from the onsite administrator of both campuses to the students at the classroom shall be submitted to the board.

7. All administrative rules governing cosmetology schools shall be strictly adhered to in both locations. New Business Pauline Cornelius moved, Blanche Thrash seconded, and the board voted unanimously to require that the cosmetology assistant examiners guidelines are updated to include approval for an assistant examiner to teach or provide continuing education or specialty classes to cosmetology licensees. Pauline Cornelius moved, Cynthia Stein seconded, and the board voted unanimously that the qualifying chronological age for continuing education exemption is sixty- five (65) years. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously that the qualifying time period for an illness hardship exemption from continuing education is three or more months. Gordon Barber moved, Pauline Cornelius seconded, and the board voted unanimously that medical illness and other circumstances continuing education waivers are temporary.

STATE OF GEORGIA COUNTY OF BIBB AFFIDAVIT SUPPORTING CLOSING OF PUBLIC MEETING The Georgia Open Meetings Act, O.C.G.A. §50-14-1 et seq., requires that all meetings of an entity covered by the statue must be open to the public unless there is some specific statutory exception which permits the closing of the meeting. If such a meeting is to be closed, the law requires that the presiding person execute a sworn affidavit stating that the subject matter of the meeting or the closed portion thereof was devoted to matters within the statutory exceptions and identifying those specific exceptions relied upon. O.C.G.A. §50-14-4(b). A copy of this affidavit must be filed with the minutes of the meeting in question: Comes now Martha Harris, the presiding officer identified below and, before an official duly authorized to administer oaths, makes this affidavit in satisfaction of the statutory requirements outlined above. 1. I am the presiding officer of the Georgia State Cosmetology Board. 2. I am over the age of 18 years of age and in all other aspects competent to make this sworn statement. I acknowledge that I am giving this statement under oath and penalty of perjury and that I have read the contents of this affidavit prior to signing it. 3. On March 3, 2004 this entity, which is subject to the Open Meetings Act, met. A majority of the quorum of the members present voted to close the meeting or a portion thereof for the following indi cated reason(s). I hereby certify that during the closed portion of the meeting, only those subjects indicated below were discussed. I also certify that I have reviewed the exceptions provided under the Open Meetings Act that may permit the closing of a meeting and that, to the best of my knowledge, the reasons I have described in detail below meet the requirements for closing this public meeting. 4. The legal authority for the closure of this meeting was: O.C.G.A.§ 43-1-2(k), 43-1-9(h) 5.
